CITY COUNCIL AGENDA REPORT
City of Anaheim
POLICE DEPARTMENT
DATE: APRIL 22, 2025
FROM: POLICE DEPARTMENT
SUBJECT: FIRST AMENDMENT TO PROFESSIONAL SERVICES
AGREEMENT WITH LYONS SECURITY SERVICE, INC. FOR
THE COLLECTION, STORAGE, AND RELEASE OF
ABANDONED PROPERTY AND PROPERTY REMOVED FROM
PUBLIC SPACES FOR SAFEKEEPING
ATTACHMENT (Y/N): YES ITEM # 12
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion:
1. Approve the First Amendment to Agreement between the City of Anaheim and Lyons Security Service, Inc. to increase the initial annual not-to-exceed amount from $475,000 to $650,000, and the total contract not-to-exceed amount from $2,000,000 to $3,000,000, for the collection, storage, and release of abandoned property and property removed from public spaces for safekeeping; and
2. Authorize the Chief of Police, or designee, to execute the First Amendment; and
3. Increase the Anaheim Police Department’s Fiscal Year (FY) 2024/25 General Fund Expense Budget by $175,000.
BACKGROUND:
The City of Anaheim regularly receives requests from residents and City departments to remove abandoned property left in public spaces. Anaheim Municipal Code Section
11.10.050 authorizes the City, under the direction of the Chief of Police, to remove such items and restore public areas to a clean and safe condition. On May 2, 2024, the Police Department issued a Request for Proposals (RFP), for services related to the collection, storage, and release of abandoned property removed from public areas. Lyons Security Service, Inc. was awarded the contract, and the City Council approved the contract on June 18, 2024, with an initial contract term of June 19, 2024, through June 18, 2025. The contract includes three annual renewal options and allows for annual compensation increases not to exceed the Consumer Price Index for the Anaheim area. The original contract established an annual not-to-exceed (NTE) amount of $475,000 for the initial term and a total contract NTE amount of $2,000,000.
First Amendment to Professional Services Agreement with Lyons Security Service, Inc. for the Collection, Storage, and Release of Abandoned Property and Property Removed from Public Spaces for Safekeeping April 22, 2025
DISCUSSION:
As part of the City’s Restoring Public Spaces initiative, a coordinated effort amongst several departments to address quality-of-life concerns and proactively support homelessness response efforts, the City requested that Lyons provide additional hours of service beyond what was anticipated when the contract was originally approved. This included increased support during daytime hours, as well as expanded coverage during nighttime hours to assist patrol officers and park rangers during overnight park clean-up operations. Specifically, Lyons added a dedicated overnight guard from 10 p.m. to 5 a.m. to support property pickups in city parks.
These enhanced services increased contract expenditures beyond what was originally projected. As a result, the Police Department anticipates exceeding the NTE amount for the initial term of the contract by approximately $75,000. Additionally, the Community Services Department has also utilized Lyons’ services under this contract and is expected to expend approximately $100,000 within the initial contract term, for a total combined NTE annual amount of $650,000.
To accommodate and sustain the current enhanced services, and address future needs, this request seeks to increase the initial annual contract NTE amount from $475,000 to $650,000, and to raise the total contract NTE from $2,000,000 to $3,000,000. In addition, the Police Department is requesting a $175,000 increase to its FY 2024/25 General Fund expense budget to cover the additional cost of the revised initial annual contract NTE amount.
IMPACT ON BUDGET:
The Police Department’s General Fund expense budget will increase by $175,000 for FY 2024/25, and future years will be subject to the City Council’s approval of budget appropriations.
Respectfully submitted,
Rick P. Armendariz
Chief of Police
