CITY COUNCIL AGENDA REPORT
City of Anaheim
COMMUNITY SERVICES DEPARTMENT
DATE: MAY 13, 2025
FROM: COMMUNITY SERVICES DEPARTMENT
SUBJECT: RIGHT OF ENTRY AND LICENSE AGREEMENT WITH ACCESS
CALIFORNIA SERVICES FOR NON-EXCLUSIVE PARKING
PURPOSES
ATTACHMENT (Y/N): YES ITEM # 21
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion, approve a Right of Entry and License Agreement (Agreement) between Access California Services (Access California) and the City of Anaheim (City) to provide additional parking spaces at 1116 Swan Street (adjacent to their existing lease of the building and facilities located at 300 W. Carl Karcher Way), with an annual fee of $1.00 per year for an initial term of five years, with two additional five-year renewal options; and authorize the Community Services Director or designee, on behalf of the City, to execute the Agreement and any related documents and to take such actions as are necessary to implement and administer the Agreement.
DISCUSSION:
In January 2022, the City Council approved a lease with Access California for the use of the grounds and facilities at 300 W. Carl Karcher Way for the purpose of providing the Anaheim community with case management and client advocacy, access to health coverage, employment services, emergency financial assistance, homeless and senior services, mental health, citizenship and immigration assistance, education and after-school activities, youth mentoring, parenting classes, veterans services, and more. As their services and programs continue to thrive, it has necessitated the need for additional parking for its employees, agents, guests, customers, and patrons. The city parking lot at 1116 Swan Street is adjacent to the 300 W. Carl Karcher Way property and will provide direct, non-exclusive ingress and egress between the two parcels during business hours from 8:00 a.m. to 5:00 p.m. Monday through Friday, excluding overnight parking, weekends, and holidays. Access California will install a City-approved gate between their Right of Entry License Area and their leased area to secure the License Area at close of business each business day.
The License Area, consisting of approximately 33,750 sq. ft. and 78 parking spaces with ingress/egress to Licensee’s property as delineated in the map, is provided on an “as is” basis, and Access California will use the permitted area at an annual cost of $1.00 per year for a five-year period, with up to two additional five-year renewal options. Access California will assume responsibility for the License Area at its sole cost and expense, Right of Entry and License Agreement with Access California Services for Non-Exclusive Parking Purposes May 13, 2025
including the installation of the fence, security persons, routine maintenance, cleaning, and trash removal.
It is further understood that the License Area is non-exclusive and shall always be open and accessible to the City for use. Should the City endeavor to proceed with any construction at the site, Access California will be provided with three (3) months' advance notice. During such time, the License Area will not be accessible to Access California.
Furthermore, the License may be terminated upon thirty (30) days' written notice by either party with or without cause.
IMPACT ON BUDGET:
There is no budgetary impact.
Respectfully submitted,
Sjany Larson-Cash
Director of Community Services
