CITY COUNCIL AGENDA REPORT
City of Anaheim

FINANCE DEPARTMENT
DATE: MAY 13, 2025
FROM: FINANCE DEPARTMENT
SUBJECT: APPROVE MASTER AGREEMENT WITH DIAMOND

ENVIRONMENTAL SERVICES LP, FOR THE RENTAL OF

PORTABLE RESTROOMS, SHOWERS, AND OTHER RELATED

SERVICES AS NEEDED
ATTACHMENT (Y/N): YES ITEM # 14
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, approve Contract MA# 106-498467 with Diamond Environmental Services LP, in an annual amount not to exceed $185,000 plus a 20% contingency, for as-needed rental of portable restrooms, showers, temporary fencing, and other related services for a one year term with two one-year optional renewals, for a total cumulative amount not to exceed $555,000; and authorize the Purchasing Agent to execute all necessary contractual documents related to the agreement in accordance with Regional Cooperative Agreement Contract Number 017-23010021 between the County of Orange and Diamond Environmental Services LP.

DISCUSSION:

The City regularly utilizes portable restroom units and temporary fencing to meet a variety of needs. These include supporting special events, facilitating construction projects, addressing temporary restroom closures in City parks, and responding to emergency situations as they arise. The demand for such resources is often time- sensitive, requiring the City to have quick access to different types and sizes of portable restrooms and fencing for varying periods.

The Public Works and Community Services Departments are the primary users of portable restroom units and temporary fencing services. The forecasted quantities for these services have been carefully calculated based on usage data for the past three (3) years. By reviewing historical trends and identifying the recurring needs of these and other departments, staff have determined the projected quantities and rental periods to ensure that sufficient resources are available. This data-driven approach helps to accurately forecast demand and ensures that the City can meet its operational needs without over-committing resources.

Currently, the procurement process for these services can be time-consuming, especially when swift access is required to support ongoing or emergency projects. To improve the City’s ability to efficiently procure these services, staff have identified an opportunity to establish a streamlined contract that ensures timely access to portable restroom units and temporary fencing across various departments and projects.

The City will benefit from this contract by gaining timely access to portable restroom units and temporary fencing, ensuring that operational goals and programs are supported efficiently. With fixed pricing and cooperative purchasing power, the City avoids cost fluctuations that often occur during periods of high demand.

This contract was awarded through a competitive solicitation conducted by the County of Orange, resulting in pre-negotiated pricing that ensures best value. As a participating agency under the County's cooperative agreement, the City benefits from these competitive rates without needing to conduct its own formal bid process. Additionally, the City receives a 1% rebate on all orders placed under this contract, generating ongoing cost savings.

To further support operational flexibility, staff is requesting City Council approval to include a contingency amount of up to twenty percent (20%) of the total contract value.

This contingency is intended to address unplanned or unknown needs that arise during the contract term, such as sudden restroom closures due to maintenance issues, vandalism, or emergency repairs. In such cases, temporary restrooms or fencing may be required to ensure continued public access and safety. The contingency would only be used on an as-needed basis with prior written authorization from the City’s Purchasing Agent and budget approval, and any unused portion will revert back to the City at the end of the contract term.

Additionally, the contract provides a flexible approach, offering a variety of unit types and sizes for rental depending on the specific requirements of each project or event. This ensures that all departments can access the right resources for their needs, regardless of the scale or timeframe involved.

The proposed contract is fully compliant with City Council Policy 4.0 and purchasing regulations. Utilizing cooperative contracts allows municipalities to maximize resources, improve service delivery, and leverage the collective purchasing power of multiple public sector entities, resulting in significant cost savings to ensure the best value for the City.

IMPACT ON BUDGET:

Sufficient funds are available in the Public Works and Community Services Departments’ Fiscal Year 2024/25 budget. Funding for subsequent years will be subject to Council’s approval of budget appropriations.
