DISCUSSION:
Anaheim Public Utilities (APU) operations require the safe handling and disposal of a variety of substances and materials, including transformer oil, treated power poles, used paint, water treatment chemicals, used batteries, light bulbs, and other substances that may be deemed hazardous. These materials require special disposal procedures throughout the year. Specially trained individuals are also needed to respond to incidents such as vehicle accidents damaging utility equipment to contain and clean the area. To comply with federal and state laws and regulations, hazardous materials must be handled by trained professionals and must be disposed of at appropriately licensed facilities. To accomplish these services, the City Council approved an agreement with Ocean Blue on July 14, 2020, following a competitive solicitation, which will expire on July 31, 2025.
The proposed contract authorizes Ocean Blue to provide all labor, materials, equipment, technical expertise, supervision, and management necessary to identify, package, clean up, and transport regulated, non-hazardous, and hazardous waste for recycling, treatment, or disposal. All services provided under this agreement will comply with applicable City, County, State, and Federal laws, regulations, and requirements. The contract may be utilized by other City departments who require environmental clean-up services, including the Public Works Department and Anaheim Fire & Rescue.
Approve Contract MA #106-498492 with Ocean Blue Environmental Services, Inc. for On-Call Environmental Clean-Up Services May 29, 2025
The scope of services includes emergency spill response and cleanup with 24/7 on-call availability. Ocean Blue guarantees a two-hour response time for hazardous material spills, ensuring rapid containment and cleanup at various City locations, including public areas and storm drains. For non-emergency waste disposal needs, the contractor will provide scheduled removal services, which include waste profiling, packaging, transportation, and final disposal. These services will be completed within a standard response time of seven days unless otherwise authorized by the City.
This contract encompasses the handling of a wide range of waste types, from small containers to bulk quantities. Ocean Blue will also provide access to a California State Certified laboratory for waste characterization and analysis. The contractor is required to maintain all necessary licenses and permits related to hazardous and regulated waste handling and must implement precautionary measures to protect public health and minimize environmental impacts.
A 20 percent contingency is recommended to address unforeseen events such as disaster- related spills or emergency situations that may require additional services or specialized equipment beyond the base scope of work.
The contract was secured using a cooperative purchasing agreement, resulting from a competitive solicitation conducted by the County of Orange. In accordance with City Council Policy 4.0 (Purchasing Procedures), the City is authorized to participate in cooperative purchasing programs when doing so is in the City’s best interest. Cooperative agreements allow municipalities to leverage the collective purchasing power of multiple public agencies to obtain favorable pricing, reduce administrative burden, and expedite the procurement process. The use of this agreement supports cost-effectiveness, transparency, and alignment with procurement best practices.
Continuing an agreement for emergency response and hazardous waste management services supports the Citywide Strategic Plan, Goal E – Support Public Safety, Strategy 5 – Assess the City’s emergency preparedness capabilities, resources, and tools, and implement changes as needed to ensure the City is properly positioned to respond to disasters.
