ATTACHMENT (Y/N): YES ITEM # 20
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion, approve the Anaheim Tourism Improvement District (ATID) Fiscal Year (FY) 2023/2024 Annual Reports for Marketing and Transportation Component Funds.
DISCUSSION:
In 2010, the City Council approved Ordinance No. 6174 and Resolution No. 2010-151, which amended Title 2 of the Anaheim Municipal Code by adding a new chapter relating to the establishment of Tourism Improvement Districts (TID) and formally established the Anaheim Tourism Improvement District (ATID) for the promotion of local tourism and convention related programs, as well as transportation improvements within The Anaheim Resort and Platinum Triangle. The ATID also provides a funding mechanism that enables the City to expand the Convention Center. The ATID operates under the general supervision and oversight of the City and under a City Council approved Management Plan. The City Council designated Visit Anaheim, formerly the Anaheim/Orange County Visitor and Convention Bureau, as the Contracting Entity to administer Marketing Component Funds. The ATID management plan established a Transportation Committee to oversee the use of Transportation Component Funds.
The terms defined in Ordinance No. 6174, Section 2.14.150.020 (Attachment 1) require Visit Anaheim and the Transportation Committee to submit annual reports to the City each fiscal year. In accordance with Section 2.14.150.040, the City Council may approve the report as filed or may modify any particular item contained in the report, and then approve it as modified. Any modification whether proposed by the Advisory Board, the Contracting Entity, or the City, shall be made subject to a public hearing with Anaheim Tourism Improvement District Fiscal Year 2023/2024 Annual Reports for the Marketing and Transportation Component Funds May 29, 2025
public notice consistent with Section 2.14.060 and subject to protest provisions in Section
2.14.070.
The ATID FY 2023/2024 Annual Reports for the Marketing and Transportation Component Funds (Attachment 2) include a description of revenues and expenditures and the types of activities completed during the period under review.
The ATID Advisory Board met on October 16, 2024, January 16, 2025, held a special meeting on March 12, 2025, and met on April 17, 2025 to discuss and scrutinize in detail the contents of the draft annual report so that a final draft report could be presented to Council that incorporated all key indicators and State of California Audit recommendations necessary for a proper assessment if the marketing efforts during fiscal year 2023/24.
The ATID Advisory Board first received a presentation of the ATID Annual Marketing Report on January 16, 2025, and requested updates, including enhanced financial information, an executive summary, with headings, and updated key performance indicators.
In addition to these recommendations, the ATID Advisory Board review included ensuring that the Annual Marketing Report also included the following, as prescribed in the enabling ordinance:
Any proposed changes in the boundaries of the tourism improvement district, any benefit zones, classification of businesses, the basis and method of levying assessments, the management plan or the activities and improvements to be funded by the assessments. The improvements and activities to be provided for that fiscal year. An estimate of the cost of providing the improvements and the activities for that fiscal year.
The method and basis of levying the assessment in sufficient detail to allow each business owner, as appropriate, to estimate the amount of the assessment to be levied against his or her business for that fiscal year.
The amount of any surplus revenues to be carried over from a previous fiscal year. The amount of any contributions to be made from sources other than assessments levied pursuant to this chapter.
A Special Meeting of the ATID Advisory Board was called on March 12, 2025, for the Board to review recommendations as requested in the January meeting and to consider approval of a Report recommendation to City Council. By unanimous vote, the Board recommended approval of the Annual ATID Marketing Report to City Council. Additionally, the Board met again on April 17, 2025, to approve the final, reported, reserve fund balances for the ATID Marketing Component funds.
Separately, A meeting of the ATID Transportation Committee was held on March 19, 2025, for the Committee to review and consider approval of a Report recommendation to City Council.
Anaheim Tourism Improvement District Fiscal Year 2023/2024 Annual Reports for the Marketing and Transportation Component Funds May 29, 2025
The ATID Committee’s review of the report was similar to the process followed by the ATID Advisory Board, and by unanimous vote, the Committee recommended approval of the Annual ATID Transportation Component Report to City Council.
These reports have been prepared in accordance with the required format and content and have been approved for submittal to the City by the ATID Advisory Board (for the Marketing Component Funds) and the ATID Transportation Committee (for the Transportation Component Funds).
The recommended report to Council is robust and this item supports Anaheim’s Strategic Plan Goal C – Invest in Infrastructure and Amenities Strategy No. 4 – Improve, enhance, beautify, and maintain major street corridors and Strategy No. 5 – Develop a mobility plan to connect major attractions. It also supports Goal F – Promote Economic Development and Tourism.
