CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JUNE 10, 2025
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: APPROVE THE DELEGATED MAINTENANCE AGREEMENT

WITH THE STATE OF CALIFORNIA DEPARTMENT OF

TRANSPORTATION
ATTACHMENT (Y/N): YES ITEM # 07
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion:
1) Determine that the projects to be performed under the attached Delegated Maintenance Agreement shall be categorically exempt under the California Environmental Quality Act (CEQA), Section 15308 of Title 14 of the California Code of Regulations; and
2) Approve the Delegated Maintenance Agreement (“Agreement”) between the City of Anaheim (“City”) and the State of California Department of Transportation (“State”) which identifies specific mission-critical maintenance services to be performed on and around the State right of way within the City’s jurisdictional limits and authorize the Director of Public Works, on behalf of the City, to execute the Agreement and related documents, including any amendments thereto, and to take any and all actions as are necessary to implement and administer the Agreement.

DISCUSSION:

On February 23, 2023 the city entered into the Clean California Maintenance Agreement which is set to expire on June 30, 2025. The State has provided the City of Anaheim with the Delegated Maintenance Agreement which includes the allocation of $200,000 in funds for litter and debris abatement. This agreement will supersede the prior Clean California Maintenance Agreement.

The City will continue to perform litter and debris removal as set forth in the Agreement.

This Agreement includes the unsheltered encampment relocation, abandoned encampments, and weed abatement. This Agreement requires the City to uphold stringent scheduling, billing, permit, payment and reporting requirements. The terms of this agreement can be terminated with 30 days written notice.

This item supports Anaheim’s Strategic Plan Goal B – Enhance Livability No. 1 – Address neighborhood and commercial blight and No. 9 – Maintain and expand services to address homelessness and its impacts.
