CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JUNE 10, 2025
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: PROPOSED SUMMARY VACATION OF A PUBLIC UTILITY
EASEMENT LOCATED AT 1024 WEST ROMNEYA DRIVE
(ABA2025-00436)
ATTACHMENT (Y/N): YES ITEM # 14
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Resolution, pursuant to California Streets and Highways Code Section 8330 et seq., vacate a portion of a Public Utility Easement at 1024 West Romneya Drive, as described in Exhibit A and as shown in Exhibit B of the attached Resolution.

DISCUSSION:

The applicant, West Romneya Apartments LLC, has requested that the City of Anaheim (City) vacate the existing Public Utility Easement to clear title to their land for the construction of a 3-story apartment building with 11 units and 2 Accessory Dwelling Units. The City acquired the ownership of the Anaheim Union Water Company property rights, which included the existing easement, through a 1964 Corporation Quitclaim Deed.

The recommended vacation meets the criteria for a summary vacation in accordance with the Streets and Highways Code because the easement has been superseded by inactive and unplanned use of water facilities located in the easements, and there are no other public facilities located within the easements. New utility services and corresponding easements will be obtained as part of the development process. The request has been reviewed by the Public Utilities Department, and there are no objections to the proposed vacation. City Council Policy No. 5.5 waives the requirements of compensation to the City when the abandonment meets the criteria for a summary vacation. Therefore, the City has no compensable interest in the easements.

IMPACT ON BUDGET:

There is no budgetary impact.
