CITY COUNCIL AGENDA REPORT
City of Anaheim

PUBLIC UTILITIES DEPARTMENT
DATE: JUNE 10, 2025
FROM: PUBLIC UTILITIES DEPARTMENT
SUBJECT: AGREEMENT WITH RAILPROS FIELD SERVICES, INC. FOR

RAILROAD SAFETY TRAINING AND FLAGGING SERVICES
ATTACHMENT (Y/N): YES ITEM # 08
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion:

1. Waive Council Policy 4.1 and approve a Master Services Agreement (Agreement) with RailPros Field Services, Inc. (RailPros) for railroad safety training and flagging services, at a not-to-exceed cost of $500,000, which will allow for an estimated five years of services under the Agreement; and

2. Authorize the Public Utilities General Manager, or designees, on behalf of the City of Anaheim (Anaheim), to execute the Agreement and any related documents, including any cost-neutral amendments of the Agreement and any documents contemplated by the Agreement, and to take such necessary or advisable actions to implement, fund, and administer the Agreement.

DISCUSSION:

At its meeting on May 28, 2025, the Public Utilities Board recommended that the City Council approve the Agreement with RailPros Field Services, Inc.

Anaheim Public Utilities (APU) operates electrical and water infrastructure on and near railroad lines owned by the Southern California Railroad Authority (SCRRA), a joint powers authority, more commonly referred to as Metrolink. SCRRA requires that anyone accessing rail-adjacent areas receives approved railroad safety training annually and that all construction work be overseen by a qualified safety flagger.

Access to these rail-adjacent areas is periodically necessary to conduct inspections, perform maintenance, relocate or construct new infrastructure, initiate emergency repairs, and complete other similar actions on infrastructure. Therefore, it is important to ensure that the necessary training and flagging services are available on short notice when required by APU or its contractors. Additionally, the Public Works Department (PW) has other city infrastructure within these rail-adjacent areas and will be able to utilize this Agreement to perform their maintenance and construction activities.

Agreement with RailPros Field Services, Inc. for Railroad Safety Training and Flagging Services June 10, 2025

Page 2 of 2 ends

Historically, SCRRA provided training and flagging with their own staff, or by using a SCRRA subcontractor. In 2023, SCRRA issued a request for proposals and the SCRRA Board of Directors selected RailPros as the exclusive firm to conduct these required safety trainings and to provide flagging services, and any entity doing work on SCRRA right-of-way would need to establish individual agreements with RailPros. SCRRA confirmed that no other firms are allowed to provide flagging and training services on their property, and APU is therefore recommending Anaheim to award this Agreement to RailPros without conducting its own competitive process, as RailPros was selected by SCRRA through a competitive process and is the solely authorized provider to SCRRA.

This Agreement will allow city staff to schedule training and flagging services in a timely manner when they need to access SCRRA areas, with a not-to-exceed cost of $500,000, which will allow for an estimated five years of services. Billing rates and fees are identified in Exhibit B of the Agreement and will be billed on a time and material basis for the services rendered. Billing rates and fees are subject to an annual adjustment by the Consumer Price Index.

IMPACT ON BUDGET:

Sufficient funds are budgeted in APU’s and PW’s Fiscal Year 2024/25 budgets, and funding for subsequent years will be subject to City Council approval of budget appropriations.

Respectfully submitted, Concurred by,
Dukku Lee Rudy Emami
Public Utilities General Manager Director of Public Works Attachment:

1. Master Services Agreement with RailPros Field Services, Inc.
