FROM: ECONOMIC DEVELOPMENT DEPARTMENT
SUBJECT: NINTH AMENDMENT TO PROFESSIONAL SERVICES
AGREEMENT BY AND BETWEEN THE CITY OF ANAHEIM
AS SUCCESSOR AGENCY TO THE ANAHEIM
REDEVELOPMENT AGENCY AND TETRA TECH BAS, INC.
ATTACHMENT (Y/N): YES ITEM: 01
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, acting as Successor Agency to the Anaheim Redevelopment Agency, by Motion:
1. Approve the Ninth Amendment to Professional Services Agreement by and between the City of Anaheim as Successor Agency to the Anaheim Redevelopment Agency and Tetra Tech BAS, Inc., increasing the maximum compensation amount by $8,140,000 from $41,709,661 to $49,849,661, for remediation activities at the Sparks, Rains, Anderson, and Davis Mud Pit Landfills;
2. Authorize the Executive Director, or designee, to execute and administer the Ninth Amendment on behalf of the City; and
3. Increase the Economic Development Department FY 2024/25 budget by $4,500,000 from the Redevelopment Property Tax Trust Fund.
DISCUSSION:
The Sparks, Rains, Anderson, and Davis Mud Pit Landfills (Landfills), located at the northeast corner of Beach Boulevard and Lincoln Avenue, are commonly known as the Lincoln Landfill (see Exhibit A). As part of the State-approved Remedial Action Plan for the Landfills, the City is required to retain a contractor to perform the operations, monitoring, and maintenance activities at the site. All activities are paid for through the Redevelopment Property Tax Trust Fund (RPTTF).
In 2014, the City of Anaheim, as Successor to the Anaheim Redevelopment Agency (City), issued a Request for Proposals (RFP) to operate, monitor and maintain the landfill gas extraction and treatment system. A contract was awarded to Tetra Tech BAS as the lowest responsive bidder; the current contract term is through October 7, 2026.

Ninth Amendment to Professional Services Agreement by and Between the City of Anaheim as Successor Agency to the Anaheim Redevelopment Agency and Tetra Tech BAS, Inc.
June 10, 2025
The Eighth Amendment to the contract currently provides authority to complete routine and non-routine remediation, operations, monitoring, and maintenance activities in the amount of $41,709,661 through the contract term. Staff is requesting a Ninth Amendment to increase the maximum compensation amount by $8,140,000 to $49,849,661.
The requested funding will be used to complete Clean Closure activities at the Davis Mud Pit and planning for the next phase of partial landfill closure at the Sparks, Anderson, and Rains Pits. This includes engineering, permitting, and construction work at the southwest edge of the landfill necessary to facilitate the development of retail along Beach Boulevard. Work will involve abandonment and reconstruction of the landfill gas collection and groundwater monitoring system, installation of a low- permeability asphalt, and associated drainage improvements.
Other activities covered under the contract include maintenance and emergency response work on the landfill gas and groundwater systems required under the Post Closure Monitoring and Maintenance Plan, and planning for final closure of the remaining portions of the Sparks, Anderson, and Rains Pits. These efforts are necessary to meet regulatory compliance standards and ensure the long-term environmental integrity of the site.
Increased funding for the proposed contract amendment has been authorized by the Orange Countywide Oversight Board and the State Department of Finance through the Recognized Obligation Payment Schedule (ROPS) process (see Exhibits B & C).
Following approval, funds are disbursed by the RPTTF administered through the County of Orange. The RPTTF is the countywide fund that accounts for the collected tax increment deposits of the former redevelopment agencies. The City must have approved contract authority to receive funds from the RPTTF.
The requested increase in contract authority will be used to fund remediation activities for the 2024-2025 and 2025-2026 ROPS cycles. At this time, the Economic Development Department is requesting a budget amendment of $4,500,000 to account for the FY 2024/25 RPTTF disbursement to the Department’s budget. The remaining amount of $3,640,000 is included in the Department’s Proposed FY 2025/26 budget for consideration in June.
IMPACT ON BUDGET:
The Economic Development Department’s Fiscal Year 2024/25 revenue and expenditure budget will be increased by $4,500,000 in the Redevelopment Successor Agency Fund..
Respectfully submitted,
Sergio M. Ramirez
