6.4 Each insurance policy required by this Agreement, excepting policies for workers' compensation and professional liability, shall contain the following clauses (or clauses of similar effect):
"It is agreed that any insurance maintained by SUBRECIPIENT pursuant to this Agreement shall be primary to, and not contributory with, any insurance or self-insurance maintained by the City of Anaheim."

Exercise of any of the above remedies, however, is an alternative to other remedies ANAHEIM may have and is not the exclusive remedy for SUBRECIPIENT's failure to maintain insurance or secure appropriate endorsements.

6.6 Nothing herein contained shall be construed as limiting in any way the extent to which SUBRECIPIENT may be held responsible for payments of damages to persons

or property resulting from SUBRECIPIENT's (or SUBRECIPIENT's contractors/subcontractor's, if any) performance of the work covered under this Agreement.

Exhibit A
ACH-COA Prop 47 Readiness to move from Hopelessness to Healthiness Model SCOPE OF WORK (eff 05/29/25)

GOAL: Provide acute care beds and develop a customized IOP program for justice involved individuals at the intersection of homelessness, mental illness, and substance use disorder. To develop a sustainable model for addressing a person’s self- perceptions of ‘hopelessness’ that occur due to inability to effectively use social determinants of health and assess their readiness for change within the context of Maslow’s hierarchy of needs by facilitating a foundation to build healthcare that addresses these social determinants of health for a target population – mentally ill (psychiatric/behavioral health) who also have co-occurring substance abuse (SA) disorders and/or those with primary SA disorders.

MODEL: The following describes the full proposed model in a stepwise manner and incorporates the structure, processes, and outcomes.

STEP 1 (Structure: Identification & Assessment): Process: The source of identification of hopelessness and the sequelae of unhealthiness that results from it is the social and legal assessments made by Anaheim PD (APD) and/or the Anaheim City Attorney’s Access program and/or Anaheim Community Hospital ACH) for individuals encountered with the aforementioned diagnoses.

Outcome(s): Identification of X number / X percentage of patients seen and referred for participation in the model of care program based on standardized assessments

STEP 2 (Structure: Eligibility): Process: The assessments will occur in the field, in custody, or in court. Once someone is identified as an “Access Candidate,” a referral form will be completed. Candidates who agree to participate will be voluntarily assessed after consulting with their lawyer and signing waivers. While in Access, participants are receiving identified grant- funded services (see Payments/Costs) not otherwise covered. Upon discharge from ACH or other location based on need, the patient is transported directly to the identified discharge destination and will begin working with the outpatient team to identify and implement solutions to the barriers identified in the Social Determinants of Health assessments (this includes, but is not limited to:
appointments, medication adherence, health education, transportation to/from meetings, supportive housing options, etc.) Outcome: Successful enrollment/placement/participation of number/percentage of eligible patients in the outpatient program, receiving outpatient long-acting medications, etc.

STEP 4 (Structure: Social Residency): Process: Daily and weekly management to support the patient’s movement forward and development of a healthiness plan
ACH Prop 47 COA team
Bridge
Housing
-communicate with Access Team weekly calls/F2F - assign a case manager to begin eligibility for services (i.e., transport, follow-up visits, etc.
- obtain documentation (i.e., DL), complete
forms, arrange/attend custodial social appts.

Healthcare
Mgmt
- perform medical assessments to ensure primary health status is maintained - arrange, attend behavioral health appointments as needed - ensure medication adherence plan is developed, implemented, and maintained - provide basic healthcare education (community health behaviors – diet, sleep, work, spiritual, emotional, psychological, physical health factors) -communicate with ACH team, weekly
calls/F2F/emails as needed

STEP 5: (Structure: Follow up): Process: Once the patient is enrolled in the ‘Access: hopelessness to healthiness’ program, the outcomes will be tracked by the COA Prop 47 team. Annual events are planned for successful “graduates”. Finally, opportunities for volunteerism by the program graduates back at ACH are supported should the patients wish to continue their health journey in a demonstrable and ‘pay-it-forward’ way.

Outcome: Days in the community, not in jail/not in hospital AND days employed (if applicable) – POST permanent housing placement.
