CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JULY 22, 2025
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: SUBDIVISION AGREEMENT OF PARCEL MAP NO. 2021-102

WITH UHT HOLDING GROUP, LLC
ATTACHMENT (Y/N): YES ITEM # 11
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, approve the Subdivision Agreement of Parcel Map No. 2021-102, with UHT Holding Group, LLC, for the subdivision of property into two parcels via a parcel map to construct a proposed drive-through restaurant on Parcel 2, located at 1061 N. Tustin Avenue.

DISCUSSION:

UHT Holding Group, LLC, which is the owner and developer of an existing shopping center located at the southwest corner of Tustin Avenue and La Palma Avenue, at 1061 N. Tustin Ave., desires to subdivide the property into two parcels via a parcel map to construct a Wendy’s Restaurant with drive-through service on Parcel 2, in accordance with the Subdivision Map Act. The Engineering for this development project is being provided by SDC of Long Beach, California.

The Planning Commission approved the Tentative Parcel Map No. 2021-102 on May 9, 2022, in conjunction with Conditional Use Permit No. 2017-05911B, which allowed a drive-through restaurant within an existing shopping center. The parcel map has been checked and found to be technically correct and in conformance with the tentative parcel map as approved by the Planning Commission.

The Conditions of Approval of the tentative parcel map require the developer to dedicate right-of-way, which is included in the map, and construct public street improvements along the development frontage. Consequently, the developer is required to enter into a Subdivision Agreement with the City to ensure that the developer completes the public improvements at the developer’s sole cost. The agreement requires that the developer posts security for the cost of the improvements to ensure that the new commercial development will have the required infrastructure to service the development. In the event the developer is unable to complete the work due to unforeseen circumstances, the City may utilize the security bonds through the bonding entity to complete the improvements as directed by the City Engineer. The improvement bonds have been posted and all tentative map conditions required prior to parcel map approval have been met.

The required public improvements include reconstruction of the sidewalks and construction of parkway landscaping along the frontage of La Palma and Tustin Avenues. These improvements are consistent with the City of Anaheim General Plan as well as the Anaheim Canyon Specific Plan and the conditions of approval of the tentative parcel map and will continue to enhance the City's infrastructure and circulation in the project area.

IMPACT ON BUDGET:
