RECOMMENDATION:
That the City Council, by Resolution, pursuant to California Streets and Highways Code section 8330 et seq., vacate the Public Utility Easements at 2972 Rome Avenue as described in Exhibits A-1 and A-2 and as shown in Exhibits B-1 and B-2 of the attached Resolution.
DISCUSSION:
The applicants, Jose M. Diaz and Beatriz S. Diaz, have requested that the City of Anaheim (City) partially vacate two existing Public Utility Easements to clear title to their land. A new Public Utility Easement was acquired on January 31, 2025, to accommodate new underground electrical and telecommunication facilities as part of a utility undergrounding project on Beach Boulevard.
The recommended vacation meets the criteria for a summary vacation in accordance with the Streets and Highways Code because the easements have been superseded by the undergrounding of utilities previously located in the easements, and there are no other public facilities located within the easements. The request has been reviewed by the Public Utilities Department, and there are no objections to the proposed vacation.
IMPACT ON BUDGET:
There is no budgetary impact. City Council Policy No. 5.5 waives the requirements of compensation to the City when the abandonment meets the criteria for a summary vacation.
Therefore, the City has no compensable interest in the easements.
