RECOMMENDATION:
That the City Council, by Resolution, pursuant to California Streets and Highways Code section 8330 et seq., vacate a Public Utility Easement at 723 North Westwood Place, as described in Exhibit A and as shown in Exhibit B of the attached Resolution.
DISCUSSION:
The applicant, Jane Gibbons, has requested that the City of Anaheim (City) vacate the existing Public Utility Easement to clear title to her land. A new Public Utility Easement was acquired on March 13, 2025, to accommodate the relocation of a utility pole and overhead electrical facilities as part of an overhead electric reliability improvement project.
The recommended vacation meets the criteria for a summary vacation in accordance with the Streets and Highways Code because the easement has been superseded by the removal of electrical facilities previously located in the easement, and there are no other public facilities located within the easement. The request has been reviewed by the Public Utilities Department, and there are no objections to the proposed vacation.
IMPACT ON BUDGET:
There is no budgetary impact. City Council Policy No. 5.5 waives the requirements of compensation to the City when the abandonment meets the criteria for a summary vacation. Therefore, the City has no compensable interest in the easements.
