A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING TWO PUBLIC UTILITY EASEMENTS
LOCATED ON ASSESSOR PARCEL NUMBER (APN) 258-011-
32, APN 258-011-33, APN 258-031-02, APN 258-031-12 AND
APN 258-031-13 PURSUANT TO CALIFORNIA STREETS
AND HIGHWAYS CODE SECTION 8330, ET SEQ. -
SUMMARY VACATION. (ABA2025-00440)
WHEREAS, the applicant, Zelman 39 Commons Partners LLC, has requested the vacation of two public utility easements generally located on APN 258-011-32, APN 258-011-33, 258-031-02, APN 258-031-12 and APN 258-031-13, in the City of Anaheim, County of Orange, State of California, as more particularly described below (individually, "Public Service Easement" and collectively, "Public Service Easements"), in order to clear title to the land because the facilities of the City of Anaheim ("City of Anaheim") have been removed or unutilized; and WHEREAS, the City of Anaheim acquired the Public Service Easements for public utility purposes ("Public Utility Purposes"); and
WHEREAS, the Public Service Easements are not necessary for present or prospective Public Utility Purposes or any other public purpose; and WHEREAS, the Public Service Easements to be vacated have been determined to be excess by the easement holder and there are no other public facilities located within the Public Service Easements.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order (1) the vacation of the Public Service Easement recorded February 7, 1990 as Instrument Number 90-069081, Official Records of Orange County and (2) the vacation of a
2.00 foot wide Public Service Easement recorded May 23, 1985 as Instrument Number 85-188097, in Book 540, Page 14-17, Official Records of Orange County both more particularly described in Exhibits “A” and “B” attached hereto and incorporated by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby makes this vacation pursuant to the requirements of the California Streets and Highways Code, Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and is hereby, authorized and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be complete and the Public Service Easements vacated shall no longer constitute public service easements of the City of Anaheim.
