CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: SEPTEMBER 9, 2025
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: PROPOSED SUMMARY VACATION OF PUBLIC UTILITY
EASEMENTS LOCATED AT 5055 AND 5065 E. SHORT STREET
(ABA2025-00441)
ATTACHMENT (Y/N): YES ITEM # 08
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Resolution, pursuant to California Streets and Highways Code section 8330 et seq., vacate two Public Service Easements located at 5055 and 5065 E.

Short Street, as described in Exhibit A and as shown in Exhibit B of the attached Resolution.

DISCUSSION:

The applicant, Link Development LLC, has requested that the City of Anaheim (City) vacate two (2) existing Public Service Easements to clear title to their land and eliminate development constraints in preparation for the construction of a new single- family residence. The easements extend beyond typical setback areas and limit the applicant’s ability to fully utilize the property.

The two easements proposed for vacation are compromised of (1) an easement for municipal and public utility purposes, originally reserved in 1967 through a County of Orange vacation of an unnamed street; and (2) an easement for public utility purposes, reserved by the City in 2024 under Resolution No. 2024-039 as part of the vacation of an excess segment of Short Street.

The 2024 easement was reserved as a precautionary measure during a time-sensitive street vacation tied to the processing of a now-recorded parcel map. The reservation allowed the City to preserve potential utility rights until formal input from all applicable utility agencies could be obtained. Input on both easements was secured through a coordinated outreach process in 2025. With utility stakeholders confirming there are no existing improvements or anticipated utility needs within either easement, both are now proposed for vacation.

The recommended vacation meets the criteria for a summary vacation in accordance with the Streets and Highways Code because the two Public Service Easements have been determined to be unutilized and excess by the City, and there are no other public facilities located within either easement area. The request has been reviewed by the Public Works and Public Utilities Departments, along with all applicable utility agencies, and there are Proposed Summary Vacation of a Public Utility Easements Located at 5055 and 5065 E. no objections to the proposed vacation. If required as a condition of the residential development process, the owner will be obligated to provide new public utility easements.

IMPACT ON BUDGET:

There is no budgetary impact. City Council Policy No. 5.5 waives the requirements of compensation to the City when the abandonment meets the criteria for a summary vacation. Therefore, the City has no compensable interest in the easements.

Respectfully submitted,
Rudy Emami
Director of Public Works
