GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion:
1. Approve the Games Agreement, in substantial form, between the City of Anaheim (City) and the Los Angeles Organizing Committee for the Olympic and Paralympic Games 2028 d/b/a OCOG (OCOG) to formalize the terms and relationship between the City and OCOG in preparation of the City and Honda Center hosting indoor volleyball during the upcoming 2028 Olympic and Paralympic Games (the 2028 Games); and

DISCUSSION:
City staff is seeking approval of the Games Agreement with the Los Angeles Organizing Committee for the 2028 Olympic and Paralympic Games (OCOG) to host a portion of the 2028 Olympic and Paralympic Games in the City of Anaheim and at the Honda Center.
In September 2016, in connection with the City of Los Angeles’ candidature for the 2024 Olympic and Paralympic Games the City, as a proposed venue city, provided a letter which set forth certain governing principles and commitments as part of the Candidature Questionnaire for Stage 1 (G1.2 and 1.3) and Stage 2 (G2.2, 2.3, 2.11, Games Agreement between the Los Angeles Organizing Committee for the Olympic and Paralympic Games 2028 d/b/a OCOG (OCOG) and the City of Anaheim

2.13, 2.25, 2.31 and 2.32), collectively the Guarantees. In September 2017, Los Angeles was formally awarded the 2028 Olympic and Paralympic Games by the International Olympic Committee (IOC) and International Paralympic Committee (IPC).
Following Los Angeles being selected to host the 2028 Olympic and Paralympic Games, in April 2025, the City and Honda Center were announced as the host city and venue for all Olympic indoor volleyball for the 2028 Games. Since April, the City and OCOG have met regularly and worked collaboratively to complete negotiations on the terms of the Games Agreement. The terms not only align with City’s strategic vision but also advocate for the interests of its residents.
The Games Agreement intends to establish the principles and commitments for City’s participation as a venue city, while also including specific terms and conditions to provide the framework for how the City and OCOG will work together and coordinate during the Games. Key elements include: outlining the City’s role, such as the process for delivery of standard and enhanced public services and arranging for the reimbursement of City expenses through supplemental agreements, to be developed between City and OCOG.
In the next few years, City and OCOG will work together to define City standard and enhanced public services for the Games, which will be formalized in the Enhanced City Resources Master Agreement (ECRMA). Additionally, a Venue Services Agreement (VSA) will specify the enhanced resources and logistics for the Games Venue (Honda Center). These Agreements, the ECRMA and VSA will be coming back for City Council approval over the next year.
The following sections summarize the key provisions of the Games Agreement:
Normal and Customary Services- The City will provide public services within the Games footprint area at its own expense. These services will be provided by the City at the same level and range as they would if the Games were not taking place.
Enhance City Resources Master Agreement- the City will provide additional public services (“Enhanced City Resources”) for the Games within the Games Footprint at OCOG’s expense. This will be detailed in a separate Agreement- the Enhanced City Resources Master Agreement.
Venue Services Agreement- the City and OCOG will negotiate and execute a Venue Services Agreement to detail the venue’s enhanced City resource, costs and access rights.
Advertising and Promotion- For advertising space under City control, the City shall help facilitate discussions between OCOG and its media operators regarding a priority option of OCOG.
Hospitality- As part of any new hotel development application and after the effective date of the Games Agreement, City shall require such developer to allow OCOG to purchase up to 90% of the hotel’s Games Agreement between the Los Angeles Organizing Committee for the Olympic and Paralympic Games 2028 d/b/a OCOG (OCOG) and the City of Anaheim

inventory for use by Games-related stakeholders during the period between June 21, 2028 - August 31, 2028. City staff does not believe this provision to be problematic as any new proposed hotel developments are already going through the Conditional Use Permit process and are currently under review/issuance, and therefore, this provision would not be imposed.
Admission/Ticket Tax – City agrees to not subject the Games and/or constituents to any future admissions taxes, parking taxes or related taxes; provided that City may take any action that it is legally required to take in connection with tax measures put on a ballot pursuant to a voter approved petition.
Sustainability and Social Responsibility- OCOG, IOC and International Paralympic Committee (IPC) aim to promote sustainable development and operations in sports by encouraging and supporting responsible concern for environmental issues and it is required the Games be conducted in alignment with these values.
Social Responsibility- OCOG is committed to delivering all-inclusive and socially responsible experience for all athletes, fans, partners and local community during the Games.
Accessibility Standards- City and OCOG will ensure accessibility is fully integrated into the Games’ planning.
Unauthorized Street Trading- the City will ensure that laws and regulations to control unauthorized street trading within the vicinity of the Games will be enforced.
Unfair Business Practices Protections- The City agrees to work in collaboration with the City of Los Angeles, OCOG and local, regional and national business, trade and services organizations to promote and encourage the charging of regular and customary prices for goods and services.
Permitting and Zoning Needs- The City will support OCOG and its applicable partners, including venue owners/operators, to streamline and provide timely review of all permitting and zoning needs for the Games.
As stated previously, should the City approve the Games Agreement, the second agreement the City will be required to enter into is an Enhanced City Resources Master Agreement (ECRMA) by October 1, 2026. The ECRMA will establish terms, service levels, unit costs, rates, repayment timelines, and audit rights for City services at OCOG expense as required that are above and beyond normal and customary City services when no special events are being conducted, including but not limited to police, fire, transportation, public works, and building safety.
Should the City approve the ECRMA, the third agreement the City will then be required to enter into is a Venue Services Agreement (VSA) by October 1, 2027. The VSA will identify the specific Enhanced City Resources that will be required at the Games Agreement between the Los Angeles Organizing Committee for the Olympic and Paralympic Games 2028 d/b/a OCOG (OCOG) and the City of Anaheim
