ATTACHMENT (Y/N): YES ITEM # 20
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion:
1. Approve a Right of Way Contract (Agreement) and a Highway Easement and Temporary Construction Easement Deeds (individually "Easement" and collectively "Easements"), in substantial form, with the Orange County Transportation Authority (OCTA) for portions of property along East Frontera Street to support the State Route (SR) 91 Segment No. 2 Improvement Project;
2. Authorize de minimis changes that do not substantially change the terms and conditions of the Agreement or Easements, as determined by the City Attorney's Office;
3. Direct the City Clerk to release the Easements to the Orange County Transportation Authority; and
4. Authorize the acceptance of a $99,155 payment.
DISCUSSION:
The Orange County Transportation Authority (OCTA), in cooperation with the State of California, Department of Transportation, is proposing the State Route (SR) 91 Segment No. 2 Improvement Project (the Project). The Project improvements will include adding one general-purpose lane, replacing the shoulder on eastbound SR-91, and restoring auxiliary lanes as needed throughout the project limits, along with other improvements such as ramp enhancements at the Kraemer Boulevard and Glassell Street interchange and various local street improvements within the City of Anaheim. The Project aims to increase freeway capacity, improve traffic and interchange operations, and enhance road safety.
Related to this Project, OCTA needs to secure a highway easement and a temporary construction easement, collectively referred to as "Easements," within the City-owned right-of-way on East Frontera Street near the North Glassell Street SR 91 eastbound on- ramp. OCTA has submitted construction plans to Public Works for installing new overhead signs, lights, and a concrete barrier on SR-91, which are expected to begin later this year. OCTA has made an offer to purchase the Easements to obtain the Right of Way Contract-Highway Easement and Temporary Construction Easement Deeds located at East Frontera Street October 28, 2025
property rights needed to certify the Project. The offer is $99,195, representing the negotiated market value of the City’s property as determined by an appraiser retained by the City.
IMPACT ON BUDGET:
Sale proceeds will be deposited into the City’s General Fund upon receipt.
Respectfully submitted,
Rudy Emami
Director of Public Works
