RECOMMENDATION:

That the City Council, by Motion, award the contract to the lowest responsible bidder, Servitek Electric Inc., of Norwalk, California, and Contractor’s License No. 1035350, Classification A, in the amount of $3,572,988 for the Advanced Dilemma Zone and left turn signal phasing modification project at seven locations (Brookhurst Street at Ball Road, Brookhurst Street at La Palma Avenue, Euclid Street at Crescent Avenue, Lincoln Avenue at Harbor Boulevard, Magnolia Avenue at Lincoln Avenue, Broadway at Magnolia Avenue, and Knott Avenue at Ball Road); find that the Project is exempt from the California Environmental Quality Act (CEQA) pursuant to Class 2, Section 15302 of the California Code of Regulations (CCR); and authorize the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; and direct and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions.

DISCUSSION:

This project will install advanced dilemma zone detection at seven intersections and install protected left-turn signal phasing at four intersections. In 2018, City staff completed an analysis to identify seven intersections with opportunities for safety improvements. The most frequent correctable collision types at those intersections were head-on, rear-end, and broadside collisions. Protected left-turn phasing was identified as needed for four of the seven intersections: Euclid at Crescent, Harbor at Lincoln, Magnolia at Broadway, and Knott at Ball, and will help reduce broadside collisions by providing a clearly designated left turn phase and eliminating the driver’s discretion to yield to oncoming traffic. Advanced dilemma zone detection was also identified as an improvement for all seven intersections and will help reduce head-on, rear-end, and broadside collisions associated with red light violations. The Award of contract for installation of advanced dilemma zone and left turn signal phasing modification project at seven locations – Brookhurst Street at Ball Road, Brookhurst Street at La Palma Avenue, Euclid Street at Crescent Avenue, Lincoln Avenue at Harbor Boulevard, Magnolia Avenue at Lincoln Avenue, Broadway at Magnolia Avenue, and Knott Avenue at Ball Road October 28, 2025

designs at the intersections include other critical features that will improve overall operation and safety, including the installation of new traffic signal cabinets, audible pedestrian signals, additional safety lighting to increase visibility at night, new illuminated street name signs to aid drivers when navigating at night, and upgraded curb ramps to meet current Americans with Disabilities Act (ADA) standards.

The project was originally bid in April 2025 with the intent to award in July 2025. Only 2 contractors bid on the project at that time, and the low bidder requested to withdraw their bid.

Because of limited bid participation and delays in the Federal Highway Administration (FHWA) review of the Second Amended and Restated Community Workforce Agreement (CWA) the project was rebid. The City of Anaheim re-advertised for bids to construct on July 24, 2025. The bid due date was August 14, 2025.

The Project bids are summarized as follows:

1. Servitek Electric, Inc., Norwalk, CA...........................................................................$ 3,572,988.00

2. Select Electric, Inc., Anaheim, CA .............................................................................$ 3,790,500.00

3. Elecnor Belco Electric, Inc., Chino, CA .....................................................................$ 3,848,888.00

4. California Professional Engineer, Inc., La Puente, CA..............................................$ 3,946,964.00

5. Alfaro Communications Construction, Inc., Compton, CA.......................................$ 4,043,957.47

6. Crosstown Electrical and Data, Inc., Irwindale, CA ..................................................$ 4,889,876.00 The city was initially awarded $1,910,900 in grant funds for construction of this project. An additional $593,025 was awarded to the city in May 2025 for a total of $2,503,925. This project also includes roadway improvements identified to use Measure M2 funds and improvements in conformance with the Circulation Element of the City of Anaheim’s General Plan. Therefore $420,550 of M2 funding will be used, as well as $648,513 of restricted transportation funds, to fund this project.

The bid price competitively falls above the engineer’s estimate, which reflects the current bidding environment, but appears to be reasonable, and is within the available funding. Liquidated damages for this project will be $4,000 per day. Construction is scheduled to begin in the 3rd Quarter of 2026 and complete in the 1st Quarter of 2027.

This item supports Anaheim’s Strategic Plan Goal A. – Maintain Financial Responsibility Strategy No. 1 – Identify potential new funding sources/revenue to increase City revenues to maintain and enhance services, and Strategy No. 2 – Continue proactive pursuit of state and federal grants.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000–21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency is required to determine if the Project is exempt from CEQA.

Award of contract for installation of advanced dilemma zone and left turn signal phasing modification project at seven locations – Brookhurst Street at Ball Road, Brookhurst Street at La Palma Avenue, Euclid Street at Crescent Avenue, Lincoln Avenue at Harbor Boulevard, Magnolia Avenue at Lincoln Avenue, Broadway at Magnolia Avenue, and Knott Avenue at Ball Road October 28, 2025

Upon review of the California Code of Regulations (CCR), staff recommends City Council determine that the Project is Categorically Exempt from CEQA pursuant to Class 2, Section 15302 (Replacement or Reconstruction) and will not cause a significant effect on the environment. Section 15302 allows for the replacement or reconstruction of existing structures (traffic signal) and facilities where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.

After determining that this Project is Categorically Exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This Project includes an allowance for the Second Amended and Restated CWA the City entered into with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions. The latest CWA is under review with the FHWA for compliance with the project’s federal grant funding.

Staff recommends that the project be awarded with an allowance to administer the Second Amended and Restated CWA if approved by FHWA. In the event that FHWA precludes the use of the CWA, or if review and approval durations would jeopardize grant expenditure deadlines, staff recommends proceeding in accordance with federal regulations and foregoing implementation of the CWA requirements.

IMPACT ON BUDGET:

Sufficient funds are available from Measure M2 and the restricted transportation funds in the Public Works Department’s FY 2025/26 Capital Improvement Program budget.

Respectfully submitted,
Rudy Emami
Public Works Director
