MILITARY EQUIPMENT ANNUAL REPORT | 2024

4 EXECUTIVE SUMMARY

On September 30, 2021, Governor Newsom approved Assembly Bill (AB) 481, requiring law enforcement agencies to obtain approval from the applicable governing body by adoption of a military equipment use policy. The Anaheim Police Department is required to seek City Council approval of its military equipment use policy by ordinance at a regular open meeting prior to taking certain actions related to the funding, acquisition, or use of military equipment, as defined.

AB 481 requires the Anaheim City Council to approve the funding, acquisition, or use of military equipment within its jurisdiction only if it determines that the military equipment meets specified standards. The ordinance is subject to an annual review by the City Council to determine whether, based on an annual military equipment report, the standards set forth in the approving ordinance have been met. The City Council may renew the authorizing ordinance, disapprove authorization for particular military equipment where standards have not been met, or require modifications to the military equipment use procedure to address any non-compliance with standards.

AB 481 also requires the publication of the military equipment use policy and the annual military equipment report on the Police Department’s website. The military equipment policy must be posted on the website at least 30 days prior to the Council meeting.

AB 481 requires every Police Department’s annual military equipment report to include the following information:
(1) A summary of how the military equipment was used and the purpose of its use. (2) A summary of any complaints or concerns received concerning the military equipment. (3) The results of any internal audits, any information about violations of the military equipment use policy, and any actions taken in response. (4) The total annual cost for each type of military equipment, including acquisition, personnel, training, transportation, maintenance, storage, upgrade, and other ongoing costs, and from what source funds will be provided for the military equipment in the calendar year following submission of the annual military equipment report. (5) The quantity possessed for each type of military equipment. (6) If the law enforcement agency intends to acquire additional military equipment in the next year, the quantity sought for each type of military equipment.

Within 30 days of submitting and publicly releasing an annual mi litary equipment report , the Anaheim Police Department shall hold at least one well -publicized and conveniently located community engagement meeting, at which the general public may discuss and ask questions regarding the annual military equipment report and the law enforcement agency’s funding, acquisition, or use of military equipment.

The Anaheim Police Department is committed to transparency, public trust, community partnerships, and compliance with the law. The Department has authored the following 202 4 Annual Military Equipment Report in accordance with annual reporting requirements set forth in AB 481.

1. A description of each type of military equipment, the quantity sought, its capabilities, expected lifespan, and product descriptions from the manufacturer of the military equipment.

2. The purposes and authorized uses for which the Department proposes to use each type of military equipment.

3. The quantities & fiscal Impact of each type of military equipment, including the initial costs of obtaining the equipment and estimated annual costs of maintaining the equipment.

4. The legal and procedural rules that govern each authorized use.

5. The training, including any course required by the Commission on Peace Officer Standards and Training (POST), that must be completed before any sworn member is allowed to use each specific type of military equipment to ensure the full protection of the public’s welfare, safety, civil rights, civil liberties , and full adherence to the military equipment use policy.

6. The mechanisms to ensure compliance with the military equipment use policy, including which independent persons or entities have oversight authority, and, if applicable, what legally enforceable sanctions are put in place for violations of the policy.

7. The procedures by which members of the public may register complaints or concerns or submit questions about the use of each specific type of military equipment, and how the Department will ensure that each complaint, concern, or question receives a response in a timely manner.

50 SUMMARY OF MILITARY EQUIPMENT USE 2024

The City of Anaheim is the tenth largest city in the State of California. It is home to over 350,000 residents, approximately 25 million annual visitors , and significant v enues, including Angel Stadium, the Honda Center, the Anaheim Convention Center, and the Disneyland Resort. In 2024, the Anaheim Police Department responded to over 203,000 calls for service. The Anaheim Police Department’s Communication Center received over 1 46,500 calls to 911 and nearly 315,000 business/non-emergency calls.

While the Anaheim Police Department’s inventory of military equipment is varied, the mere possession of the equipment does not warrant its use for every incident. The Department recognizes that critical incidents are unpredictable and dynamic. Various military equipment options allow officers to de-escalate or safely resolve an incident. The use of military equipment is restricted to use only in specific incidents by officers who are trained to use the equipment.

The Department’s Tactical Response Group (TRG) is comprised of two specialized teams: the Special Weapons and Tactics Team (SWAT) and the Tactical Negotiations Unit (TNU). The Tactical Response Group has been established to provide specialized support in handling critical field operations requiring intense negotiations and special tactical deployment methods . The following are examples of incidents that may result in the activation of the Tactical Response Group (TRG):
• Barricaded suspects who refuse an order to surrender. • Incidents where hostages are taken.
• Arrests of dangerous persons.
• Any situation where TRG could enhance the ability to preserve life, maintain social order, and ensure the protection of property, as determined by the TRG Commander.

In 2024, the Department’s Tactical Response (TRG) conducted 46 operations. These operations included the following:
• SWAT Team Operations
o 2 hostage rescues
o 24 high-risk search and/or arrest warrants
o 18 barricaded suspect incidents
o 4 large venue security operations (11 days total)
• 23 Tactical Negotiation Unit Operations (SWAT team was not required or deployed)

This section outlines the military equipment use d during 202 4. Certain items of military equipment, particularly consumables ( ammunition, diversionary devices, Pepperb alls, chemical agents, etc.), are used throughout the year for training to maintain proficiency. Training usage is not captured in this section. This section only provides information on the operational use of military equipment in this annual report.
