CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: NOVEMBER 4, 2025
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: AMEND THE SANITARY SEWER IMPACT AND
IMPROVEMENT FEES FOR THE EAST ANAHEIM
AREA
ATTACHMENT (Y/N): YES ITEM # 20
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, following a public hearing, by Resolution, approve and adopt the amended Sewer Impact and Improvement Fees (Fees) for the East Area of the City of Anaheim and determine such actions are exempt from the California Environmental Quality Act pursuant to Public Resources Code Section 21080 (b)(8) and Guideline Section 15273 (a).
DISCUSSION:
The Department of Public Works has Sanitary Sewer Impact and Improvement Fees for three areas of the city that are amended after each update of the corresponding Master Plan. These are the West Area, the Central Area, and the East Area of Anaheim. The East Anaheim Area is generally bounded on the north by the northern city limits, on the west by the Orange Freeway (SR-57) and the Central Anaheim Master Plan of Sanitary Sewers Study Area, on the south by the southern city limits, and on the east by the eastern city limits. The East Anaheim Area consists of approximately 14,550 acres in gross area and a population of approximately 60,500 people per the 2020 census. The area is substantially developed and designated as a mix of residential, commercial, and industrial land uses. The infrastructure within the East Anaheim Area is relatively new compared to the rest of the city since the area was developed more recently.
The East Anaheim Master Plan of Sanitary Sewers Addendum dated August 2024 and adopted on April 22, 2025, by Resolution No. 2025-035, and the East Anaheim Master Plan of Sanitary Sewers Financial Implementation Plan (FIP) Addendum dated August 2024 and adopted on September 23, 2025, by Resolution No. 2025-085, addresses build- out conditions from the new entitlement in the East Anaheim Area from the General Plan Focused Update and 2021-2029 Housing Element Update Project Development Application Nos. 2021-00223 and 2021-00002. The FIP explored potential funding sources and concluded that a Sanitary Sewer Impact and Improvement Fee structure is the most practical approach to finance the development-related sanitary sewer needs on an ongoing basis.

The proposed Fees were calculated to address the projected wastewater flows at build-out condition, will supersede the current Sewer Impact Fee for the East Anaheim Area, and will be adjusted annually pursuant to the Anaheim Municipal Code. Proposed impact fees were estimated by dividing costs allocated to new users by the projected wastewater flows at build-out. The overall cost for the build-out improvements recommended is higher due to the substantial rise in construction costs and additional deficiencies identified. The cost of the improvements is being dispersed throughout a larger variety of land uses in the entire East Anaheim Area.

This Plan supports Anaheim’s Strategic Plan Goal A – Maintain Financial Responsibility, Strategy
1. Identify potential new funding sources/revenue to increase City revenues to maintain and enhance services; and Strategy 3. Modernize development impact fees.
ENVIRONMENTAL DETERMINATION:
In accordance with CEQA (Public Resources Code Section 21080 (b)(8)) and pursuant to Section 15273(a)(4) of Title 14 of the California Code of Regulations (CCR), the City of Anaheim, as Lead Agency, is required to determine if the Resolution is exempt from CEQA.
Upon review of the CCR, staff recommends that the City Council determine the Resolution is Categorically Exempt from CEQA pursuant to paragraph (a) (4), Section 15273 of Title 14 of the CCR which states CEQA does not apply to the establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, and other charges by public agencies which the public agency finds are for the purpose of obtaining funds for capital projects, necessary to maintain service within existing service areas.
After determining that the Resolution is Categorically Exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.
IMPACT ON BUDGET:
If adopted, the proposed Sanitary Sewer Impact and Improvement fees will be deposited in the Restricted Sewer Construction Fund.
