CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: DECEMBER 9, 2025
FROM: DEPARTMENT OF PUBLIC WORKS AND DEPARTMENT OF
COMMUNITY SERVICES
SUBJECT: AWARD OF CONTRACT TO DEVELOPERS GENERAL
CONTRACTING, INC. FOR BROOKHURST PARK SPLASH
PAD PROJECT
ATTACHMENT (Y/N): YES ITEM # 06
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion:
1) Award the Contract to the lowest responsible bidder, Developers General Contracting, Inc., of Irvine, California, Contractor’s License No. 1132320, Classification B, in the amount of $1,376,988 with a 10% contingency for the Brookhurst Park Splash Pad Project (Project);
2) Determine the Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Class 1, Section 15301(a)(c)(e) 2(A)(B) (Existing Facilities), Class 3, Section 15303(d)(e) (New Construction or Conversion of Small Structures), and Class 4, Section 15304(b)(f) (Minor Alterations to Land) of Title 14 of the California Code of Regulations; and
3) Authorize the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; and direct and authorize the Finance Director to execute the Escrow Agreement pertaining to contract retentions.
DISCUSSION:
The Project consists of the construction of a new splash pad at Brookhurst Park. The splash pad will be located within an underutilized area of the park, adjacent to the existing moonscape playground. Improvements include, but are not limited to, ground spray elements, mechanical building, seating, concrete pathway, three shade structures, and other associated site work. Once constructed, it will be the City’s third splash pad.
Award of Contract for Brookhurst Park Splash Pad Project December 9, 2025
The Project bids are summarized as follows:
1. Developers General Contracting, Inc., Irvine, CA . . . . . . . . . . . . . . . . . $1,376,988 The Project was first advertised in mid-October of 2025. Of the four potential bidders who expressed interest by attending a non-mandatory Pre-Bid Site Meeting, only one contractor ultimately submitted a bid. According to the report generated from the City’s procurement platform, OpenGov, the firms that chose not to bid cited reasons related to their own operations, such as being unable to meet the bid due date due to current backlog, or not offering the services sought, reasons of which were outside staff’s control while advertising for bids.
With the Department’s goal to complete construction by the start of the warm season for Anaheim residents to fully enjoy the splash pad amenities, staff does not find value in re-bidding the Project and recommends the award of the Contract to Developers General Contracting, Inc.
The bid price is consistent with the engineer’s probable cost estimate of $1,300,000, which reflects the current bidding environment, appears to be reasonable and is within the available funding. Liquidated damages are set for $1,500 per day. Construction is scheduled to begin in the 1st Quarter of 2026 and is scheduled to be completed by 2nd Quarter of 2026.
This Project supports the City’s Strategic Plan Goal C – Invest in Infrastructure and Amenities, Strategy 11 – Review and implement the Parks Master Plan, and Strategy 2 – Continue proactive pursuit of state and federal grants.
COMMUNITY WORKFORCE AGREEMENT (CWA):
This Project is covered under “Project Work” as defined in the Second Amended and Restated Community Workforce Agreement (CWA) that the City entered with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions.
ENVIRONMENTAL DETERMINATION:
In accordance with CEQA (Public Resources Code Sections 21000-21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim as Lead Agency is required to determine if the Project is exempt from CEQA.
Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 1, Section 15301(a)(c)(e) 2(A)(B) (Existing Facilities), Class 3, Section 15303(d)(e) (New Construction or Conversion of Small Structures), and Class 4, Section 15304(b)(f) (Minor Alterations to Land) of Title 14 of the CCR.
After determining that this Project is categorically exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.
IMPACT ON BUDGET:
Funding for this Project is included in the Community Services Department’s FY 2025/26 Capital Improvement Program budget from Development Impact Fees, and through a U.S.
