CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: DECEMBER 9, 2025
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: PROPOSED VACATION/ABANDONMENT OF TWO SEGMENTS OF EXCESS STREET RIGHT OF WAY ABUTTING 275 AND 301 EAST
SANTA ANA STREET (ABANDONMENT NO. ABA2024-00434)
ATTACHMENT (Y/N): YES ITEM # 20
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, following a public hearing:

1. By Resolution, approve the proposed vacation/abandonment of two segments of Santa Ana Street right-of-way situated between Philadelphia Street and Olive Street; and between Claudina Street and Philadelphia Street;

2. By Motion, approve the Offer and Agreement to Purchase Real Property ("Agreement"), in substantial form, for the sale of excess right-of-way from the City of Anaheim ("City") to MTHCALV-I SANTA ANA STREET, LLC, a Delaware limited liability company, its successors and assigns ("Buyer") in the amount of $30,000; authorize and direct the Public Works Director to execute the Agreement and authorize the Mayor to sign the Quitclaim Deed, and authorize de minimis changes that do not substantially change the terms and conditions of the agreements, so long as the changes are determined to be de minimis by the City Attorney’s Office;

3. By Motion, authorize and direct the Public Works Director or his designee to execute other documents on behalf of the City as required to close the transaction; and

4. By Motion, authorize and direct the City Clerk to hold the recordation of the Resolution and Quitclaim Deed in the Orange County Recorder's office until directed by the Public Works Director or his designee.

DISCUSSION:

The duly noticed public hearing was continued from the October 28, 2025 City Council meeting. This abandonment has been requested by the developer, MLC Holding, LLC, a California limited liability company (doing business as Meritage Homes and holding title as MTHCALV-I SANTA ANA STREET), to clear title for the construction of a residential project. The abandonment request is for two segments of the Santa Ana Street right-of-way, totaling approximately 1,103 square feet, to be assembled into the adjacent property owned by the developer, generally located at 275 and 301 East Santa Ana Street.

On November 13, 2024, the City Council approved project entitlements, which included the approval of Tentative Tract Map No. 19290, to create a one-lot condominium map to construct 56 townhomes.

These segments of Santa Ana Street proposed for abandonment fall outside the ultimate right-of-way and are not required for current or future public use. City staff reviewed the proposed abandonment and confirmed that the segments are not necessary for any current or prospective public street use.

Based on the foregoing, city staff have determined that the right-of-way under consideration for abandonment is considered to be excess right of way, unnecessary for present or prospective use in accordance with Section 8324(b) of the Streets and Highways Code.

City Council Policy No. 5.5 contemplates compensation to the City for the fair market value of any applicant requesting the abandonment or vacation of any easement, right-of-way, or other property interest. The Real Property Section, responsible for recommending fair market value, determined that a separate appraisal for this abandonment request was unnecessary given the minimal square footage of the right-of-way proposed for abandonment and the nominal contribution the area provides to additional development. City staff analyzed the value based on the factors above and the dedication of the right-of-way, conditioned on the approval of the tract map, and compared it with similar projects for which appraisals were obtained. As a result, staff have determined the fair market value of the right- of-way to be $30,000.

IMPACT ON BUDGET:

Sale proceeds will be deposited into the City’s General Fund upon receipt.

Respectfully submitted,
Rudy Emami
Director of Public Works
