Accessory Dwelling Units/Junior Accessory Dwelling Unit: This Amendment updates and clarifies ADU and JADU regulations to align with State law.
Existing Code:
Contains incorrect Government Code sections due to re-numbering by the State. Allows one Accessory Dwelling Unit (ADU) and one Junior Accessory Dwelling Unit (JADU) on a property with a single-family residence (SFR). Requires a JADU to be located within the primary dwelling. Requires a deed restriction for a JADU for owner occupancy requirement.
Proposed Changes:
Revises the permitted number and location of ADUs allowed on a property with an SFR to permit:
o One attached ADU converted from existing space within the primary dwelling,
o One new construction ADU, and
o One JADU located either within the primary dwelling or attached to a new detached ADU.
Eliminates the deed restriction requirement for a JADU, except when the unit shares a sanitation facilities with the primary unit.
Makes it easier to find ADU size limitations based on the primary unit. Provides clear language that no development standard may prevent construction of an 800 square foot ADU, except for life-safety requirements. Clarify that adding an ADU or JADU does not trigger fire sprinkler installation in a primary dwelling that does not already have them.
