CITY COUNCIL AGENDA REPORT
City of Anaheim
COMMUNITY SERVICES DEPARTMENT
DATE: DECEMBER 16, 2025
FROM: COMMUNITY SERVICES DEPARTMENT
SUBJECT: APPROVE A RIGHT OF ENTRY AND LICENSE AGREEMENT WITH NORTHGATE GONZALEZ MARKETS, INC. FOR NON-
EXCLUSIVE USE OF PARKING LOT AT DELPHI PARK
ATTACHMENT (Y/N): YES ITEM # 12
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:
That the City Council, by Motion, approve a Right of Entry and License Agreement between Northgate Gonzalez Markets, Inc. dba Northgate Gonzalez LLC and the City of Anaheim to provide parking space at Delphi Park, located at 1211 N. Magnolia Avenue, for an initial term of five years, with two additional five-year renewal options, in the annual license amount of $1.00; and authorize the Director of Community Services, or designee, to execute and administer the Agreement on behalf of the City.
DISCUSSION:
Delphi Park, located at 1211 N. Magnolia Avenue, features two baseball fields and a large parking lot. This park is primarily used for baseball practices and games by local non- profit youth leagues in the evenings and on weekends. Northgate Gonzalez Markets, Inc. (Northgate) operates its main distribution center and corporate office adjacent to Delphi Park and has requested use of the parking lot when needed for additional parking to accommodate its employees, guests, and other visitors during daytime hours when the lot is not typically used by park patrons. In exchange for use of the parking lot, Northgate will assume responsibility for water and electrical utility expenses associated with Delphi Park, will slurry seal and restripe the parking area every three to five years as needed, provide security monitoring services of the property, and trim park palm trees adjacent to the parking area annually.
A Right of Entry and License Agreement (Agreement) has been developed to provide the requested access. Per the terms of the Agreement, the City will provide direct, non- exclusive ingress and egress to the parking lot during Northgate’s business hours, Monday through Friday, from 7:00 a.m. to 4:00 p.m. Additionally, 20% of the parking spaces will remain available for use between 4:00 p.m. to 5:00 p.m., Monday through Friday. The Agreement prohibits overnight, weekend, and holiday parking by Northgate.
The term of the Agreement is for a five-year period, with up to two additional five-year renewal options. Furthermore, the License may be terminated upon one-year written notice by either party.
Approve a Right of Entry and License Agreement with Northgate Gonzalez Markets, Inc. for Non-Exclusive Use of Parking Lot at Delphi Park
