Development Application No. 2025-00041 (Second Reading) January 13, 2026
DISCUSSION:
On December 16, 2025, the City Council introduced an Ordinance amending Title 6 (Public Health and Safety), Title 14 (Traffic), and Title 18 (Zoning) of the Anaheim Municipal Code (Code) as part of the City’s annual Code Update Program intended to provide to provide clarity, create consistency of terms and definitions, streamline processes, comply with changes in State law to existing regulations, reflect current market trends, and support City Council Strategic Plan priorities. A Summary of the proposed changes is provided as Attachment 4. Concurrently, the City Council also introduced two additional Ordinances, amending Title 6 (Public Health and Safety), adding Chapters 6.103 (Nitrous Oxide) and 6.105 (Kratom) to regulate the sale of nitrous oxide to prevent illegal and recreational use and to regulate the sale, distribution, and possession of kratom. Attachment 5 is the December 16, 2025 City Council staff report.
If adopted, the subject Ordinances will become effective in 30 days.
Environmental Impact Analysis: Staff recommends that the City Council determine that the proposed amendments are not subject to CEQA. The amendments do not involve any physical changes to the environment and do not have the potential for causing a significant effect on the environment. Thus, the activity is exempt from CEQA under Sections 15060(c)(2), 15060(c)(3), 15378, and 15061(b)(3) of the CEQA Guidelines.
IMPACT ON BUDGET:
The costs to process and implement this Code amendment are included in the Department’s FY 2025/26 General Fund budget.
Respectfully submitted,
Heather Allen
Planning and Building Director
