ACTION:
That the City Council, discuss and take possible action to waive the attorney-client privilege as to a Memo dated January 26, 2026 from the City Attorney’s Office – Ethics Division to the Mayor and City Council regarding “Gift Reporting Requirements for Section 87200 Filers (Form 700) and Analysis of Resort Stay Provided by a Donor” (“Memo”).
DISCUSSION:
On January 27, 2026, Mayor Ashleigh Aitken agendized an item for the Council to consider waiving the attorney-client privilege as to a confidential memorandum dated January 26, 2026 that was sent from the Ethics Division of the Office of the City Attorney to the City Council. A decision by the Council to waive the privilege would mean that the Memo would become a public record and could be made available for public review.
IMPACT ON BUDGET:
No budget impact.
