Re: Wyndham Hotel Density Modification Project in the City of Anaheim: Notification per Assembly Bill 52 (AB 52) and Senate Bill 18 (SB 18)
Dear Nathan Banda:
Thank you for your interest in proposed development projects in the City of Anaheim. The provisions of Assembly Bill 52 and Section 21080.3.1(d) of the Public Resources Code require formal notification of proposed projects in the geographic area that is traditionally and culturally affiliated with your tribe. This notification is for the purpose of offering the opportunity to request a consultation to protect any tribal cultural resources that may exist in the planning area. Also, pursuant to the provisions of Senate Bill 18 (SB 18) and Government Code 65352.3, the lead agency must notify local Native American tribes of any general plan amendment request, also for the purpose of consultation to protect cultural resources that may exist in the planning area.
Proposed Project: Wyndham Hotel Density Modification Project Project Location: The approximately 1-acre project site is at 515 West Katella Avenue in the central portion of the City of Anaheim in Orange County. Regional access to the project site is from Interstate 5 (I-5), approximately 0.6 mile to the east via West Katella Avenue, and from State Route 22 (SR-22), approximately 2.5 miles to the south via South Harbor Boulevard. Local access to the project site is via Disney Way and South Clementine Street (see Figure 1, Site Aerial).
Project Description: In 1996, t he Planning Commission approved Final Site Plan (FSP) 95-03, which allowed
for the development of a 4-story, 72-room, suite-type hotel. The original Wyndham Hotel building plans were designed with several dual suites that included two bedrooms and two bathrooms with internal connecting doors and one keyed entry door. Following the approval of the hotel’s site plan , additional entry doors were added to these rooms to create two separate keyed rooms. Some dual suites also had their interior connecting doors removed. Changes were also made to the use of space on the first floor , but no square footage was added. Space that was previously approved for storage , offices, and ancillary guest areas were converted to a large conference room/meeting rooms and a restaurant that is open to the general public (total of 6,394 square feet [SF]). The footprint of the building and remainder of the site did not change.
Therefore, the Wyndham Hotel is seeking a modification to the allowable density for the parcel , from the permitted 75 hotel rooms per acre or parcel to 106 hotel rooms, with 6,394 SF in accessory uses. The proposed project would require a general plan amendment from “Low-Medium Density” (up to 75 rooms per gross acre or 75 rooms per lot of parcel) to a new density category “Medium Density (Modified B)” to allow for up to 106 hotel rooms and 6,394 SF of accessory uses . The proposed project would also require a Specific Plan Amendment to the Anaheim Resort Specific Plan to create a new density category, “Medium Density (Modified B)”, and an update of relevant maps and exhibits with the new density category. No new construction or ground activity is proposed under this application.

Dear Alexis Wallick:
Thank you for your interest in proposed development projects in the City of Anaheim. The provisions of Assembly Bill 52 and Section 21080.3.1(d) of the Public Resources Code require formal notification of proposed projects in the geographic area that is traditionally and culturally affiliated with your tribe. Re: Wyndham Hotel Density Modification Project in the City of Anaheim: Notification per Assembly Bill 52 (AB 52) and Senate Bill 18 (SB 18)
Dear Vanessa Minott:

I would also like to make note that this project does not involve any ground disturbing activities.
This project proposes to increase the allowed room density for an existing hotel. When the hotel was originally constructed, they had a variety of two-bedroom suites that have since separated into individually-keyed hotel rooms; thereby increasing the total room count/density for the property. There is no additional construction proposed under this application.

Subject: Formal Request for Government-to-Government Consultation -Wyndham Hotel Modification Project in the City of Anaheim
Dear Amanda Lauffer,
On behalf of the Gabrieleno Band of Mission Indians Kizh Nation, I am formally requesting government-to- government consultation with the City of Anaheim pursuant to Assembly Bill 52 (AB 52) and the California Environmental Quality Act (CEQA) regarding the proposed Wyndham Hotel Modification Project in the City of Anaheim. Our tribe has ancestral and cultural ties to this area, and we are concerned that the project may impact Tribal Cultural Resources (TCRs) within our traditional territory.
Under AB 52, lead agencies are required to engage in meaningful government-to-government consultation with our tribe who is ancestrally traditionally and culturally affiliated with the project area when the project undergoes CEQA review, in accordance with the law.
We request that formal consultation be initiated within the required timeframe, and we are prepared to meet at your earliest convenience. Please confirm receipt of this request and provide available dates for an initial consultation meeting.
For scheduling or further discussion, please contact me at [email protected] or (844) 390 - 0787.
We appreciate your commitment to ensuring compliance with AB 52 and protecting the cultural heritage of our tribal community.

Wyndham Hotel Density Modification Project in the City of Anaheim: Notification Per Senate Bill 18 Dear Amanda Lauffer:
The Pala Band of Mission Indians Tribal Historic Preservation Office has received your notification of the project referenced above. This letter constitutes our response on behalf of Robert Smith, Tribal Chairman.
We have consulted our maps and determined that the project as described is not within the boundaries of the recognized Pala Indian Reservation. The project is also beyond the boundaries of the territory that the tribe considers its Traditional Use Area (TUA). It is, however, situated in close proximity to the Reservation and information generated would likely be useful in better understanding regional culture and history. Therefore, we request as a courtesy to be kept in the information loop as the project progresses and would appreciate being maintained on the receiving list for project updates. Further, if the project boundaries are modified to extend beyond the currently proposed limits, we do request updated information and the opportunity to respond to your changes. We defer to the wishes of the Tribes who are in closer proximity to the project area.
We appreciate involvement with your initiative and look forward to working with you on future efforts.
