Re: Westgate Resorts Anaheim
Westgate Anaheim GardenWalk Resort
Second Amended & Restated Development Agreement No. 99-01, as amended (collectively, the "Development Agreement")
Vacation Ownership Resort No. 1
Dear Ms. Lauffer:

On behalf of Westgate, owner of the Vacation Ownership Resort No. 1 and related Development Agreement, we respectfully request an extension to the timeframes for development, which previously required obtaining building permits by April 15, 2025, and completing the project within two years of that date. We request an extension of approximately three years to Commence Construction by October 31, 2028, and Complete Construction and Open for Business by October 31, 2030.

We previously partnered with a developer to make these rooms a reality, securing an architect and hotel flag, and working with the City's Planning and Building Department, only to have the deal eventually end due to circumstances outside of our control. We continue to market the entitled project to potential investment partners and/or potential buyers. While our understanding from staff is that the project could be fully developed without the benefit of a Development Agreement, the Development Agreement provides a level of certainty beneficial to potential investors new to Anaheim as well as to lenders by providing clarity and predictability during ownership transition, reducing perceived regulatory risk, and improving the project's ability to be underwritten, financed, and ultimately delivered. We are hopeful you will consider our request based on our sincere efforts to make these hotel rooms part of the Anaheim Resort District.
