CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: FEBRUARY 24, 2026
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: PROPOSED SUMMARY VACATION OF A PUBLIC SERVICE
EASEMENT LOCATED AT 7581 E. COUNTRY HILL LANE
(ABA2025-00442)
ATTACHMENT (Y/N): YES ITEM # 14
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council:

1. By Resolution, pursuant to California Streets and Highways Code section 8330 et seq., vacate a portion of a Public Service Easement located at 7581 E. Country Hill Lane, as described in Exhibit A and as shown in Exhibit B of the attached Resolution; and

2. By Motion, authorize the City Clerk to hold the recordation of the Resolution in the Orange County Recorder’s office until directed by the Public Works Director or his designee.

DISCUSSION:

The applicant and property owner of 7581 E. Country Hill Lane has requested that the City of Anaheim (City) vacate a portion of an existing Public Service Easement to clear title to his land and eliminate development constraints in preparation for the construction of a new single-family residence. The easement extends beyond typical setback areas and limits the applicant’s ability to fully utilize the property.

The easement was dedicated to the City on Parcel Map No. 88-290 to secure utility rights for future public water and sewer facilities, and emergency access to surrounding parcels that at the time lacked direct access. However, subsequent subdivision of land, construction of detached single-family residences, and dedications of public easements and emergency access has rendered the portion of the easement within 7581 E. Country Hill Lane unnecessary for present or prospective public purposes.

The recommended vacation meets the criteria for a summary vacation in accordance with the Streets and Highways Code because the Public Service Easement has been determined to be unutilized and excess by the City. If vacated, the City would reserve a public utility easement for existing water facilities located at the southwest corner of the property.

There are no other public facilities located within the remaining easement area. The request has been reviewed by Public Works, Anaheim Public Utilities, and Anaheim Fire Proposed Summary Vacation of a Public Service Easement Located at 7581 E. Country Hill Lane February 24, 2026

& Rescue, and there are no objections to the proposed vacation. If required as a condition of the residential development process, the owner will be obligated to provide new public utility easements.

IMPACT ON BUDGET:

There is no budgetary impact. City Council Policy No. 5.5 waives the requirements of compensation to the City when the abandonment meets the criteria for a summary vacation. Therefore, the City has no compensable interest in the easements.

Respectfully submitted,
Rudy Emami
Director of Public Works
