Findings of Fact in Support of a Statement of Overriding Consideration:
The Findings inadvertently state that the Project would conflict with the provisions of an adopted Habitat. The corrected language is:
Basis for Conclusion:
The Project would not conflict with the provisions of an adopted Habitat Conservation Plan, Natural Community Conservation Plan, or other approved local, regional, or State habitat conservation plan; thus, no impact would occur.
Development Agreement:
Article 2 (Public Benefits) was updated to include a $100,000 contribution to the Anaheim Police Department to fund evacuation training, planning, and other related preparedness activities (noted as #7).
Section 3.6.4 was revised to note Impact Fees are subject to applicable inflator. Section 3.6.7 and 3.6.8 were added to clarify that the monetary contributions to Anaheim Fire and Rescue and Anaheim Police Department should be paid in a lump sum payment no later than the issuance of the first Building Permit. Additional language was added to note that if paid at least one year after the effective date of the Development Agreement, the amount of the contributions shall be increased to reflect an annual inflationary increase.
Exhibit D was amended to remove “Affordable Housing Fees” from the list of required Impact Fees for the project.
