CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: MARCH 3, 2026
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: SUBDIVISION AGREEMENT OF PARCEL MAP NO. 2020-178 ATTACHMENT (Y/N): YES ITEM # 03
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Motion, approve the Subdivision Agreement of Parcel Map No. 2020-178, with Zelman 39 Commons Partners, LLC, for the subdivision of property to construct a new retail shopping center, located at 208 N. Beach Blvd.

DISCUSSION:

Zelman 39 Commons Partners, LLC, which is the owner and developer of an existing parcel of land located at the northeast corner of Beach Boulevard and Lincoln Avenue, at 208 N.

Beach Blvd., desires to subdivide the property into 5 parcels to construct a new retail shopping center in accordance with the Subdivision Map Act. Four of the parcels are buildable and will contain one multi-tenant retail building and three separate restaurants with drive-through service. One of the parcels is not buildable and will only contain the primary driveway access to Beach Boulevard. The engineering for this development project is provided by DRC Engineering of Anaheim, California.

The Planning Commission approved the Tentative Parcel Map No. 2020-178 on May 9, 2022, in conjunction with Conditional Use Permit No. 2021-06114, which allowed three separate drive-through restaurants within the new shopping center under Final Site Plan No. 2021-00001. The parcel map has been checked and found to be technically correct and in conformance with the tentative parcel map as approved by the Planning Commission.

The Conditions of Approval of the tentative parcel map require the developer to dedicate right-of-way, which is included in the map, and construct public street improvements along the development frontage. Consequently, the developer is required to enter into a Subdivision Agreement with the City to ensure that the developer completes the public improvements at the developer’s sole cost. The agreement requires the developer to post security for the cost of the improvements to ensure that the new commercial development will have the required infrastructure to service the development. In the event the developer is unable to complete the work due to unforeseen circumstances, the City may utilize the security bonds through the bonding entity to complete the improvements as directed by the City Engineer.

The improvement bonds have been posted, and all tentative map conditions required prior to parcel map approval have been met.

The required public improvements include reconstruction of the sidewalks and construction of parkway landscaping along the frontage of Beach Blvd. and Lincoln Avenue. These improvements are consistent with the City of Anaheim General Plan as well as the Beach Boulevard Specific Plan and the conditions of approval of the tentative parcel map and will continue to enhance the City's infrastructure and circulation in the project area.

IMPACT ON BUDGET:

There is no budgetary impact.

Respectfully submitted,
