CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: APRIL 21, 2026
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: COOPERATIVE AGREEMENT WITH THE CITY OF BUENA

PARK FOR THE DALE STREET REHABILITATION FROM
CRESCENT AVENUE TO SR-91 PROJECT
ATTACHMENT (Y/N): YES ITEM # 14
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, approve the Cooperative Agreement (Agreement) between the City of Anaheim (Anaheim) and the City of Buena Park (Buena Park), in an amount not-to-exceed $56,000, plus a 10% contingency, for a total authorized amount of $61,600, for Anaheim’s share of the construction of the Dale Street Rehabilitation from Crescent Avenue to State Route 91 Project (Project), and authorize and direct the Director of Public Works or designee, on behalf of the City of Anaheim, to execute the Agreement and any related documents, and to take any and all actions necessary to implement and administer the Agreement.

DISCUSSION:

Dale Street between Crescent Avenue and State Route 91 (SR-91), is located primarily within the City of Buena Park, with a portion of the roadway located within the City of Anaheim. Buena Park has proposed to rehabilitate the segment of Dale Street in Anaheim to extend the service life of the roadway and minimize the inconvenience to the traveling public if rehabilitated with their Project.

The Project generally consists of asphalt concrete pavement rehabilitation; removal and reconstruction of concrete improvements, including curb and gutter, sidewalk, and ADA- compliant curb ramps; adjustment of utility structures; and other appurtenant and miscellaneous work necessary to complete the Project.

Under the terms of the Agreement, Anaheim agrees to reimburse Buena Park for 100% of the actual construction costs associated with work performed within Anaheim’s jurisdiction, based on bid unit prices and actual quantities constructed. The estimated not- to-exceed cost for Anaheim’s portion of the work is $56,000, plus a 10% contingency of $5,600, for a total authorized amount of $61,600.

Buena Park will be responsible for preparing plans and specifications, obtaining environmental clearance, coordinating utility adjustments, advertising and awarding the construction contract, and administering construction, including inspection and contract change orders. Anaheim will retain oversight responsibilities for work within its Cooperative Agreement with the City of Buena Park for the Dale Street Rehabilitation from Crescent Avenue to SR-91 Project April 21, 2026

jurisdiction, including review and approval of plans, change orders within the Anaheim right-of- way construction permits. Upon completion of construction, Buena Park will provide Anaheim with Record Drawings and a Notice of Completion. Anaheim will reimburse Buena Park within the timeframe specified in the Agreement following receipt of an itemized invoice and acceptance of the work.

Construction of the Project is anticipated to begin in the second quarter of 2026 and be completed in the third quarter of 2026.

This Project supports Anaheim’s Strategic Plan Goal C - Invest in Infrastructure and Amenities, Strategy No. 4 – “Improve, enhance, beautify and maintain major street corridors” and Strategy No. 8 – “Invest in the expansion and maintenance of the paving program to achieve a Pavement Condition Index (PCI) of 75+/-.”
ENVIRONMENTAL DETERMINATION:

The Agreement establishes Buena Park as the Lead Agency. In accordance with the California Environmental Quality Act (CEQA) (Public Resources Code Sections 21000–21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), Buena Park, as Lead Agency, is required to determine if the Project is exempt from CEQA.

Buena Park has made the determination that the Project is Categorically Exempt from CEQA pursuant to Class 1, Section 15301 (Existing Facilities) of Title 14 of the CCR, which allows for the repair, maintenance, or minor alteration of existing public or private structures, involving negligible or no expansion of use beyond that existing at the time of the Lead Agency’s determination.

IMPACT ON BUDGET:

Adequate funding is available in the Public Works Department’s restricted Transportation Funds, Wastewater Funds, and the Public Utilities Department’s Water Utility Fund for the Fiscal Year 2025/26 budgets.

Respectfully submitted,
Rudy Emami
Director of Public Works
