CITY COUNCIL AGENDA REPORT
City of Anaheim
DEPARTMENT OF PUBLIC WORKS
DATE: APRIL 21, 2026
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: PROFESSIONAL SERVICES AGREEMENTS FOR ON-CALL
CONSULTING SUPPORT WITH CLEAN WATER ACT PERMIT
COMPLIANCE PROGRAMS
ATTACHMENT (Y/N): YES ITEM # 15
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion:
1) Approve the Professional Services Agreements(Agreements) for on-call consulting support services for Clean Water Act Permit Compliance Programs, to the Department of Public Works (Department), with the following eight (8) consulting companies, in the not-to-exceed amount of $600,000 per year for a 1- year term, with 4 one-year optional renewals, to support the Development Services Section of the Department: EEC Environmental, Fuscoe Engineering, Inc., Geosyntec Consultants, Inc., GSI Environmental, Inc., Michael Baker International Inc., Recupero and Associates, Inc., Tetra Tech, Inc., WSP USA Inc. (collectively, “Consultants”); and
2) Authorize and direct the Director of Public Works to execute each Agreement, and take any and all actions as are necessary to implement and administer the Agreements; and
3) Authorize de minimis changes that do not substantially change the terms and conditions of the Agreements, so long as such changes are determined to be de minimis by the City Attorney’s Office.
DISCUSSION:
The Department currently retains six (6) qualified Consultants to assist in the development, refinement and revision of City-wide programs to help comply with two State Permits issued to, and implemented by, the City. These are the National Pollutant Discharge Elimination System (NPDES) Permit for the Municipal Separated Storm Sewer System (MS4) and the Sewer Waste Discharge Requirements (WDR) Permit.
These permits mandate the development of guidance documents and the implementation of programs and activities City-wide, which are intended to prevent pollution from entering the storm drain system, thereby improving water quality in local rivers, the ocean and groundwater.
Professional Services Agreement for On-call Consulting Support with Clean Water Act Permit Compliance Programs April 21, 2026
The current Agreements with six (6) Consultants will expire in August of 2026. Therefore, on December 18, 2025, a Request for Proposal (RPF) was advertised on OpenGov. Twelve (12) responsive proposals were received on February 5, 2026, and were evaluated by a review board, consistent with Council Policy 4.1. The Consultants listed below were deemed most qualified based on the criteria in the Policy.
1. EEC Environmental
2. Fuscoe Engineering, Inc.
3. Geosyntec Consultants, Inc.
4. GSI Environmental, Inc.
5. Michael Baker International, Inc.
6. Recupero and Associates, Inc.
7. Tetra Tech, Inc.
8. WSP USA, Inc.
The Department will utilize these Consultants for a wide range of professional services, including but not limited to development of technical studies, procedures and programs; providing plan check and project management services, application for and administration of grants funds, among other various tasks. The wide range of services needed relative both to sewer and storm drain regulations and infrastructure, necessitates securing multiple consultants in various disciplines. Therefore, eight (8) Consultants, each with a range of capabilities and expertise, have been selected.
While each of the eight (8) Agreements are for a not-to-exceed amount of $600,000, there is no guarantee of work for any individual consultant. The total amount typically expended is anticipated to be $1,600,000 per fiscal year for all Agreements.
IMPACT ON BUDGET:
Sufficient appropriation is included in the Department’s Proposed FY 2026/27 Wastewater Fund budget to support the anticipated expenditure, which will be presented to City Council in June.
Respectfully submitted,
Rudy Emami
Director of Public Works
