ATTACHMENT (Y/N): YES ITEM # 11
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, approve an Agreement with Cho Design Associates, Inc., in the amount of $68,088, plus a 15% contingency for a total not-to-exceed amount of $78,301.20, to provide engineering design services related to the Anaheim West Tower Window Project (Project) and authorize the Director of Public Works, or designee, to execute the Agreement and any related documents, and to take any and all actions as are necessary to implement and administer the Agreement.

DISCUSSION:

In March 2024, Representative Young Kim led efforts on the City’s federal appropriations request of $1,500,000 to support the City’s Emergency Operations Center (EOC) relocation project. The request was successfully earmarked in the Fiscal Year 2024 federal budget, allocating funding from the Federal Emergency Management Agency (FEMA) EOC Grant Program for this Project. FEMA's EOC Grant Program provides funding to enhance local emergency management capabilities, with over $100 million available nationwide for Fiscal Year 2024 to support secure, interoperable, and resilient facilities.

The FEMA EOC Grant Program is intended to improve emergency management and preparedness capabilities by supporting flexible, sustainable, secure, strategically located, and fully interoperable EOCs with a focus on addressing identified deficiencies and needs.

Fully capable emergency operations facilities at the state and local levels are an essential element of a comprehensive national emergency management system and are necessary to ensure continuity of operations and continuity of government in major disasters or emergencies caused by any hazard. Aligning with the grants’ purpose of improving deficiencies, the City will be placing a ballistic reinforcement system around parts of the interior perimeter of the EOC that are vulnerable to line of sight. As part of this process, the City will procure consultant services through the engineering design phase.

2. Mark Anderson Architects, Inc., Huntington Beach, CA Cho Design Associates was selected as the top firm based on the following: a) their understanding of the scope of work, b) the qualifications of the proposed staff, c) the firm's costs, and d) their ability to adhere to the established schedule.

The base contract fee amount is $68,088, plus a 15% contingency of $10,213.20, for a total not-to- exceed contract amount of $78,301.20. The contingency will cover expenditures for required work not included in the original Scope of Services.

The National Environmental Policy Act (NEPA) environmental clearance has been completed through the FEMA grant process. Design is anticipated to be completed by the end of the third quarter of 2026, and construction is anticipated to start in the first quarter of 2027.
