2) Determine the Project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Class 1 (Existing Facilities) Section 15301(a)(c)(d)2(A)(B), Class 2 (Replacement or Reconstruction) Section 15302, Class 3 (New Construction or Conversion of Small Structures) Section 15303(c)(e), Class 4 (Minor Alterations to Land) Section 15304(b)(f), and Section 15300.2 (c) of Title 14 of the California Code of Regulations; and 3) Authorize and direct (a) the Director of Public Works, on behalf of the City of Anaheim (City), to execute the Contract and any other related documents and to take such actions as are necessary, required, or advisable to implement and administer the Contract; and (b) the Finance Director to execute the Escrow Agreement pertaining to contract retentions in accordance with Public Contract Code section 22300.

DISCUSSION:

The Project bids are summarized as follows:

1. Moalej Builders, Inc., Newport Beach, CA .......................$1,571,276.25

2. Ankor Associates Inc., Los Angeles, CA ..........................$1,712,465.02

Moalej is recommended for the construction award as the lowest responsible bidder. The bid price is slightly higher than the engineer’s probable cost estimate of $1,230,000, which reflects the current bidding environment, appears to be reasonable, and is within the available funding.

Liquidated damages are set for $1,000 per day.

The Project is Phase 1 of the future Boysen Park Renovation and consists of the construction of a new skate park. The skate park will be located within an underutilized area of Boysen Park, at the north-east corner of Vermont Ave. and State College Blvd., near the existing playground.

Improvements will include a skate park with a bowl, quarter pipe, mini half pipe, rails, ledges, etc.; a seat wall; two (2) shade structures; planting; a stormwater management system; an interpretive sign; and other appurtenant work as shown on the approved plans and specifications.

Once constructed, this will be the City’s 9th skate park.

The Project was advertised in mid-April 2026. Five (5) bids were received. The Project specifications required that bidders submit a Statement of Qualifications with past projects of similar size and scope to be deemed responsive and responsible. Based on the information submitted on the Statement of Qualifications, staff determined that the lowest bidder has met the minimum requirements. Construction is scheduled to begin in the 3rd Quarter of 2026 and be completed by the 4th Quarter of 2026.

This Project supports the City’s Master Plan for Boysen Park Renovations and Strategic Plan Goal C – Invest in Infrastructure and Amenities, Strategy 11 – Review and implement the Parks Master Plan, and Strategy 2 – Continue proactive pursuit of state and federal grants.

COMMUNITY WORKFORCE AGREEMENT (CWA):

This Project is covered under “Project Work” as defined in the Second Amended and Restated Community Workforce Agreement (CWA) that the City entered with the Los Angeles/Orange Counties Building and Construction Trades Council and the Signatory Craft Councils and Local Unions.

ENVIRONMENTAL DETERMINATION:

In accordance with CEQA (Public Resources Code Sections 21000-21177) and pursuant to Section 15061 of Title 14 of the California Code of Regulations (CCR), the City of Anaheim as Lead Agency is required to determine if the Project is exempt from CEQA.

Upon review of the CCR, staff recommends that the City Council determine the Project is Categorically Exempt from CEQA pursuant to Class 1 Section 15301(a)(c)(d)2(A)(B) (Existing Facilities), Class 2 Section 15302 (Replacement or Reconstruction), Class 3 Section 15303(c)(e) (New Construction or Conversion of Small Structures), Class 4 Section 15304(b)(f) (Minor Alterations to Land), and Section 15300.2 (c) of Title 14 of the CCR.

After determining that this Project is categorically exempt from CEQA, the City will file a Notice of Exemption with the County Clerk, which starts a 35-day statute of limitations for challenges of the decision.
