THE SANTA ANA RIVER PROJECT (R/W ACQ2025-01684 AND
R/W ACQ2026-01746)
ATTACHMENT (Y/N): YES ITEM # 13
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion, approve the Offer and Agreement to Purchase Real Property (Agreement) for the City’s acquisition of a Permanent Bridge Easement and Temporary Construction Easement from the Orange County Flood Control District (OCFCD) for the Orangewood Avenue Bridge Widening over the Santa Ana River Project (Project), in the amount of $55,000, authorize and direct the Director of Public Works and City Clerk to execute the Agreement on behalf of the City and to take such actions as are necessary to implement and administer the Agreement and any related documents; and authorize the Director of Public Works to execute and accept the Permanent Bridge Easement Deed and Temporary Construction Easement Deed and subsequently execute an Assignment Deed conveying the Permanent Bridge Easement to the City of Orange consistent with Cooperative Agreement AGR-10938 and authorize the City Clerk to cause said Deeds to be recorded in the Office of the Orange County Recorder.

DISCUSSION:

The Department of Public Works is acquiring a Permanent Bridge Easement and Temporary Construction Easement (TCE) from the Orange County Flood Control District (OCFCD) to construct the Orangewood Avenue Bridge Widening Project over the Santa Ana River.

The Project is part of the City of Anaheim’s Platinum Triangle Implementation Plan (PTIP), Update #4 for Public Works Backbone Facilities Improvements, identified as a portion of Project 3D. The Project will widen the existing Orangewood Avenue bridge over the Santa Ana River to the SR-57 Freeway to improve regional traffic circulation and multimodal access. Improvements include an additional westbound travel lane, an improved sidewalk along the north side of the bridge, bridge seismic retrofit improvements, drainage improvements, retaining walls, and utility relocations. The Project will also include the installation of a new City of Orange water transmission main within the bridge to Eckhoff Street.

The Santa Ana River channel is owned and maintained by OCFCD. The agreed purchase price of $55,000 for the Permanent Bridge Easement and TCE is based on fair market value as supported by an approved appraisal. The Permanent Bridge Easement is necessary to construct, operate, inspect, maintain, and repair the widened bridge structure within the Santa Ana River. The TCE is required to provide access for demolition, grading, staging, and construction activities associated with the Project. The TCE includes a river area limited to temporary construction activities subject to all applicable regulatory permits and a riverbank area to be potentially used for staging construction, vehicle parking, material stockpiling, and temporary equipment storage.

Upon approval of the Agreement, the Director of Public Works will execute and accept the Permanent Bridge Easement Deed and Temporary Construction Easement Deed conveying to the City of Anaheim the real property interests required for the Project and authorize the City Clerk to attest and cause said Deeds to be recorded in the Office of the Orange County Recorder.

Consistent with Agreement and Cooperative Agreement AGR-10938, following the acquisition and recordation of the Permanent Bridge Easement from OCFCD, the City of Anaheim will execute an Assignment Deed conveying the Permanent Bridge Easement to the City of Orange.

Construction of the Project is anticipated to begin in the third quarter of 2026. Construction activities will be phased to comply with Santa Ana River environmental work windows and regulatory permit conditions. Project construction is anticipated to be completed in the fourth quarter of 2029.

This Project supports Anaheim’s Strategic Plan Goal C - Invest in Infrastructure and Amenities, Strategy No. 4 – “Improve, enhance, beautify and maintain major street corridors.”
ENVIRONMENTAL DETERMINATION:

The Project is consistent with the previously certified Final Subsequent Environmental Impact Report (SEIR) No. 339 for the Revised Platinum Triangle Expansion Project.

Addendum No. 9 to SEIR No. 339 evaluated the Project improvements, including the bridge widening and related infrastructure improvements.

The proposed right-of-way acquisition is within the scope of the approved Project and does not constitute a separate project under CEQA. No further environmental review is required pursuant to CEQA Guidelines Section 15164.
