CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JUNE 23, 2026
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: THIRD AMENDMENT TO COOPERATIVE AGREEMENT NO.

MA-080-19010444 WITH THE COUNTY OF ORANGE FOR

FUNDING, DESIGN, AND CONSTRUCTION FOR THE
BROOKHURST STREET WIDENING, PHASE 2
ATTACHMENT (Y/N): YES ITEM # 13
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:

That the City Council, by Motion:
1) Approve Amendment No. 3 (Amendment) to Cooperative Agreement No.

MA-080-19010444 with the County of Orange (County) for the Brookhurst Street Widening, Phase 2 Project (Project), updating the Boundary Adjustment and Maintenance responsibilities of the Project area following completion of the Project; and,
2) Authorize and direct the Director of Public Works or designee, on behalf of the City of Anaheim, to execute Amendment No. 3 and any related documents, and to take any and all actions as necessary to implement and administer the Agreement.

DISCUSSION:

Brookhurst Street is designated as a six-lane major arterial highway on the Orange County Transportation Authority (OCTA) Master Plan of Arterial Highways. In June 2015, the City of Anaheim (City) widened Brookhurst Street from Ball Road to Katella Avenue from four to six lanes (with the exception of the segment from Guinida Lane to Cerritos Avenue, which was widened to five lanes) as part of the Brookhurst Street Widening, Phase 1.

The County of Orange (County) requested the City to widen Brookhurst Street from Cerritos Avenue to 150 feet north of Guinida Lane (Project) to add a third southbound lane within the County limits due to the need to accommodate the high volume of 31,000 vehicles per day per OCTA's 2016 Traffic Flow Map.

In 2018, the County and the City entered into Cooperative Agreement No.

MA-080-19010444, in which the City agreed to be the lead agency for the design, Third Amendment to Cooperative Agreement No. MA-080-19010444 with the County of Orange for Funding, Design, and Construction for the Brookhurst Street Widening, Phase 2

right-of-way engineering, and construction of the Project, and that the County would acquire the right-of-way and pay the actual costs and expenses of the Project within the existing County right-of-way from County Road Funds. The County agreed to reimburse the City during the design and construction phases.

On January 26, 2021, the City Council approved Amendment No. 1 to the Cooperative Agreement, increasing the County and City’s contributions to accommodate improvements not previously accounted for in the original scope of work. In addition, Amendment No. 1 included language to allow the County to be the lead to perform the boundary adjustment along the west side of Brookhurst Street from north of Guinida Lane to Cerritos Avenue in order to have the street and parkway in its entirety within the City’s jurisdiction, and it also changed the term of the Agreement.

On December 20, 2022, the City Council approved Amendment No. 2 to the Cooperative agreement, further increasing the County and City’s contributions to accommodate the additional pavement restoration, reflect escalated construction costs, and additional right-of-way acquisition costs. Additionally, the Amendment eliminated the requirement to declare Brookhurst Street as a County Highway since it was not needed for the County to acquire the required right-of-way for the Project.

Amendment No. 3 will update the Boundary Adjustment and Maintenance responsibilities of the Project area following completion of the Project. The City will now be the lead agency performing the right-of-way boundary adjustment through the Local Agency Formation Commission of Orange County (“OC LAFCO”), and the County is quitclaiming all its property rights in the Project area to the City to have the street and parkway in its entirety within the City’s jurisdiction. The City will also be responsible for the Project area being transferred to the City.

Additionally, the boundary line splits the curb ramp at the northwest corner of Cerritos Avenue and Brookhurst Street, and the City will take responsibility for the ongoing maintenance of that curb ramp as it is being constructed in accordance with City Standards.

The Project’s construction contract was awarded to Toro Enterprises, Inc. on April 21, 2026, by City Council in the amount of $3,825,688. Construction is anticipated to begin in early July 2026 and will last 120 working days. Construction is anticipated to be completed in January 2027.

This Project supports Anaheim’s Strategic Plan Goal C - Invest in Infrastructure and Amenities, Strategy No. 4 – “Improve, enhance, beautify and maintain major street corridors” and Strategy No. 8 – “Invest in the expansion and maintenance of the paving program to achieve a Pavement Condition Index (PCI) of 75+/-.”
