CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JULY 28, 2026
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: PROPOSED SUMMARY VACATION OF EASEMENTS FOR PUBLIC

UTILITY AND PUBLIC PURPOSES GENERALLY LOCATED AT
200 WEST MIDWAY DRIVE (ABA2025-00444)
ATTACHMENT (Y/N): YES ITEM # 12
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Resolution, pursuant to California Streets and Highways Code section 8330 et seq., vacate certain easements for public utility and public purposes generally located at 200 West Midway Drive, as described in Exhibits “A-1” through “A-6” and as shown in Exhibits “B-1” through “B-6” of the attached Resolution.

DISCUSSION:

The applicant, Lennar Homes of California, LLC (Lennar), has requested that the City of Anaheim (City) vacate various easements to clear title to land in conjunction with the development of 156 multi-family condominium units. Most of the public utility easements proposed for vacation were originally reserved when streets and alleys dedicated under Tract Map No. 419 (1923) were subsequently vacated in 1956, 1970, and 2024. Additional easements include: (1) an electrical easement originally granted to Southern California Edison and assigned to the City in 1975, (2) an easement for water facilities granted to the City by deed in 1986, and (3) an easement for public purposes granted to the City by deed in 1994.

The recommended vacation meets the criteria for a summary vacation in accordance with the Streets and Highways Code because the Public Service Easements have been superseded by relocation or have not been used for the purposes for which they were dedicated or acquired for a period of at least five consecutive years immediately preceding the proposed vacation. The City has determined that the easements are excess and there are no other public facilities located within the easement areas. The request has been reviewed by the Public Works and Public Utilities Departments, and there are no objections to the proposed vacation. As a condition of the development process, the developer will be obligated to provide new public utility easements and dedicate easements for public purposes on Tract Map No. 19112 (pending approval and recordation). In addition, a new public sewer easement will be dedicated through a separate instrument.

IMPACT ON BUDGET:

There is no budgetary impact. City Council Policy No. 5.5 waives the requirements of compensation to the City when the abandonment meets the criteria for a summary vacation. Therefore, the City has no compensable interest in the easements.

Respectfully submitted,
Rudy Emami
Director of Public Works
