CITY COUNCIL AGENDA REPORT
City of Anaheim

DEPARTMENT OF PUBLIC WORKS
DATE: JULY 28, 2026
FROM: DEPARTMENT OF PUBLIC WORKS
SUBJECT: PROPOSED SUMMARY VACATION OF A PUBLIC SERVICE
EASEMENT GENERALLY LOCATED AT 1501-1551 WEST
LINCOLN AVENUE (ABA2026-00452)
ATTACHMENT (Y/N): YES ITEM # 13
GOVERNMENT CODE § 84308 APPLIES: YES
RECOMMENDATION:

That the City Council, by Resolution, pursuant to California Streets and Highways Code section 8330 et seq., vacate a Public Service Easement generally located at 1501-1551 West Lincoln Avenue, as described in the attached Resolution.

DISCUSSION:

The applicant, the City of Anaheim Economic Development Department, has requested that the City of Anaheim (City) vacate an existing Public Service Easement to clear title to the land and eliminate development constraints in preparation for the construction of a McKenna Porsche automobile dealership. The easement extends beyond typical setback areas and limits the developer’s ability to fully utilize the site.

The Public Service Easement, reserved for public purposes, namely sewer, drainage, water, and electrical purposes, was reserved by the City in 2004 under Resolution No. 2004-229 as part of the vacation of a portion of Manchester Court. At that time, following the widening of the I-5 Freeway, the Anaheim Redevelopment Agency sought to facilitate the consolidation and development of several remnant parcels acquired from the Orange County Transit Authority for commercial development. Accordingly, the excess street right-of-way was vacated, while an easement was reserved for the existing public utility facilities located within the former Manchester Court right-of-way.

Pursuant to the 2025 Disposition and Development Agreement (AGR-15290) between the City and Manchester Lincoln, LLC, an affiliate of the McKenna Auto Group, for the development of a Porsche dealership and service facility on the subject property, the Anaheim Economic Development Department has initiated the easement vacation process. The proposed vacation will facilitate the dealership development, which will enhance the Lincoln Avenue corridor and complement ongoing revitalization efforts in the area.

The recommended vacation meets the criteria for a summary vacation in accordance with the Streets and Highways Code because the Public Service Easement has been rendered excess following the relocation or abandonment of public utility facilities previously Proposed Summary Vacation of a Public Service Easement Generally Located at 1501-1551 West Lincoln Avenue (ABA2026-00452) July 28, 2026

located within the easement area. A minor electrical facility under the City’s control remains temporarily in place and will be relocated before the conveyance of the property, with any necessary replacement utility rights established as part of the property disposition process. The request has been reviewed by the Public Works and Public Utilities Departments, along with all applicable utility agencies, and there are no objections to the proposed vacation. As a condition of the commercial development process, the developer will be obligated to provide any public utility easements determined necessary by the City.

IMPACT ON BUDGET:

There is no budgetary impact. City Council Policy No. 5.5 waives the requirements of compensation to the City when the abandonment meets the criteria for a summary vacation. Therefore, the City has no compensable interest in the easements.

Respectfully submitted,
Rudy Emami
Director of Public Works
