1 ORDINANCE NO. _____
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING DEVELOPMENT APPLICATION NO.
2026-00022, ADOPTING AMENDMENTS TO TITLE 18
(ZONING) OF THE ANAHEIM MUNICIPAL CODE TO
IMPLEMENT THE SIXTH CYCLE HOUSING ELEMENT AND
MAINTAIN CONSISTENCY WITH STATE HOUSING LAW
AND FINDING AND DETERMINING THAT THIS
ORDINANCE IS NOT SUBJECT TO THE REQUIREMENTS TO
PREPARE ADDITIONAL ENVIRONMENTAL
DOCUMENTATION PER CALIFORNIA ENVIRONMENTAL
QUALITY ACT (CEQA) GUIDELINES, SECTION 15061(B)(3)
AND CALIFORNIA PUBLIC RESOURCES CODE SECTION
21080.085 BECAUSE IT WILL NOT HAVE A SIGNIFICANT
EFFECT ON THE ENVIRONMENT
DEVELOPMENT APPLICATION NO. 2026-00022
WHEREAS, the City of Anaheim initiated Development Application No. 2026- 00022 to consider amendments to various sections of Title 18 (Zoning) of the Anaheim Municipal Code for the purpose of implementing programs identified in the City’s Sixth Cycle Housing Element (2021–2029), maintaining consistency with State housing law, and supporting continued compliance with requirements of the California Department of Housing and Community Development (“HCD”); and
WHEREAS, in spring 2025, the City Council approved the Sixth Cycle Housing Element and associated implementation actions following a recommendation by the Planning Commission, and on July 10, 2025, HCD determined that the City’s Housing Element was in subs tantial compliance with State Housing Element Law; and
WHEREAS, Section Four of the Housing Element establishes a Housing Policy Program identifying implementation actions and timelines necessary to address present and future housing needs, comply with State law, affirmatively further fair housing, and provide opportunities for housing production, conservation, and preservation; and
WHEREAS, the proposed amendments to Title 18 implement a number of Housing Element programs and strategies including the following:
a. Housing Production Strategy 1I: Amendments to facilitate affordable housing opportunities on Religious and Community Facilities sites, consistent with state law requirements, including Senate Bill (SB) 4;
b. Housing Production Strategy 1U: Establishment of replacement housing requirements to ensure one -for-one replacement of protected residential units and preservation of affordability consistent with State law; 2 c. Housing Conservation and Preservation Strategy 2E(i): Revisions to definitions for Single Housekeeping Unit and Boarding House to clarify applicability and maintain consistency with State housing and fair housing laws;
d. Housing Conservation and Preservation Strategy 2E(ii): Amendments to standards applicable to Community Care Facilities and Sober Living Homes to establish clearer and more objective operational standards and maintain compliance with State housing laws; and
e. Affordable Housing Opportunity Strategy 5O: R evisions to emergency shelter regulations to maintain consistency with State law; and
WHEREAS, the Planning Commission of the City of Anaheim did hold a duly noticed public hearing on June 15, 2026, to consider Development Application No. 2026- 00022 and thereafter recommended City Council approval of amendments to Title 18 (Zoning) of the Anaheim Municipal Code; and
WHEREAS, the City Council did hold a duly noticed public hearing on _______, 2026 at the Civic Center in the City of Anaheim to consider Development Application No. 2026-00022, at which time and place interested persons were given an opportunity to be heard and the City Council did receive and consider evidence and testimony presented at said hearing; and
WHEREAS, the City Council did receive, review, and consider the staff report, Planning Commission recommendation, proposed municipal code amendments, and other evidence submitted in connection with Development Application No. 2026-00022; and
WHEREAS, the City Council finds and determines that the proposed amendments are consistent with the goals, policies, and implementation programs of the General Plan, including the Housing Element, because the amendments facilitate Housing Element implementation, remove regulatory barriers to housing, maintain compliance with State housing and fair housing requirements, and support the City’s obligation to provide for existing and projected housing needs; and
WHEREAS, the City Council further finds and determines that the proposed amendments promote the public health, safety, and general welfare by clarifying development standards, improving internal consistency of the Anaheim Municipal Code, establishing objec tive standards where required by State law, and providing greater certainty in the administration of housing- related land use regulations; and
WHEREAS, the City Council finds and determines that this ordinance is not subject to the requirements to prepare additional environmental documentation because: (1) pursuant to CEQA Guidelines Section 15061(b)(3) , the request is for a Code amendment and adjustment to clarify technical provisions of the Code and therefore , would not have a significant effect on the environment; and (2) the zoning and specific plan amendments are statutorily exempt pursuant to Section 21080.085 of the California Public Resources Code because they implement the schedule of actions contained in the City's Housing Element.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS:
