A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM VACATING AN IRREVOCABLE OFFER
OF DEDICATION OF PUBLIC ACCESS EASEMENT FOR
EMERGENCY SERVICES, SOLID WASTE/TRASH
COLLECTION, VEHICULAR AND PEDESTRIAN FOR
PUBLIC USE PURSUANT TO CALIFORNIA STREETS
AND HIGHWAYS CODE SECTION 8330, ET S EQ. -
SUMMARY VACATION. (ABA2025-00443)
WHEREAS, the applicant, Anaheim Real Estate Partners, LLC, TS Anaheim , LLC, and FCD, LLC, has requested the vacation of that certain irrevocable offer of dedication of public access easement for emergency services, solid waste/trash collection, vehicular and pedestrian for public use generally located in the City of Anaheim, County of Orange, State of California, as more particularly described below "Irrevocable Offer of Dedication of Easement", in conjunction with the development known as "OCVibe," and WHEREAS, the City of Anaheim ("City of Anaheim") received the Irrevocable Offer of Dedication of Easement for various public purposes; and WHEREAS, the Irrevocable Offer of Dedication of Easement to be vacat ed is excess public access and public use which is not required for public use or other municipal purpose, as the City of Anaheim has acquired an equivalent replacement easement.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Anaheim does hereby order the vacation of the Irrevocable Offer of Dedication of Easement as described in Exhibits “A” and “B” attached hereto and incorporated by reference.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim hereby order the vacation pursuant to the requirements of the California Streets and Highways Code, Division 9, Part 3, Chapter 4.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of the County of Orange, California.
BE IT FURTHER RESOLVED that the City Clerk be, and is hereby, authorized and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder of the County of Orange, California.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be co mplete and the Irrevocable Offer of Ded ication of Easement for public access easement for emergency services, solid waste/trash collection, vehicular and pedestrian
for public use is hereby terminated and shall no longer constitute an easement for street highway, or public service easement or offer for same.
