RECOMMENDATION:
That the City Council:

By Motion, authorize and direct the City Clerk to withhold the Resolutions dedicating certain City-owned properties for public road, utility, and other municipal purposes from recordation with the Orange County Clerk-Recorder until the Public Works Director or designee provides written confirmation that the applicable right- of-way improvements have been completed and accepted by the City.
DISCUSSION:
The applicant, Anaheim Real Estate Partners, LLC, TS Anaheim, LLC, and FCD, LLC (OCVIBE) has requested the vacation and dedication of the City's real property interest as part of the overall OCVIBE Master Site Plan (Project). The Project is a mixed-use Proposed Dedication of Certain City-Owned Properties for Public Road, Utility, and Other Municipal Purposes; Summary Vacation of an Irrevocable Offer of Dedication for Public Access shown on Tract Map No. 19153 (ABA2025-00443); and Summary Vacation of Segments of Excess Douglass Road Right-of-Way (ABA2026-00451)

development surrounding Honda Center and the Anaheim Regional Transportation Intermodal Center (ARTIC) that requires the reconfiguration and construction of streets, access routes, utilities, and other public improvements. Implementation of the Project affects several real-property interests held by the City, including City-owned property, public street rights-of- way, public access rights, utility easements, and irrevocable offers of dedication. As roadway and site designs are finalized, certain City property interests must be dedicated, vacated, relocated, replaced, or supplemented to preserve necessary public access, circulation, utility service, and the City’s long-term property interests.
The four proposed Resolutions implement separate but coordinated real-property actions arising from the approved roadway and site improvements. Two Resolutions will dedicate portions of City-owned property as public right-of-way for the Douglass Road and River Road Phase III improvements. A third resolution will vacate the City’s interest in an irrevocable offer of dedication that has been replaced by a separately recorded public access easement. The fourth Resolution will vacate portions of existing Douglass Road right-of-way that fall outside the ultimate right-of-way required by the City-approved street-improvement plans.
Dedication of City-Owned Property for Street Purposes
Implementation of approved roadway improvements requires portions of two City-owned properties to be formally dedicated for road, utility, and other municipal purposes. One area is located on the ARTIC property and is needed to accommodate the approved Douglass Road configuration described in Resolution No. 1. The second area is located adjacent to the former Anaheim Equestrian Center and is needed for the River Road Phase III improvements described in Resolution No. 2. Although the City owns these properties in fee, the affected areas have not been formally dedicated as public street right- of-way. The proposed dedications will align the limits of the public right-of-way with the approved roadway configuration and establish the affected areas for public road, utility, and related municipal uses.
The dedications will not convey the properties to another party or divest the City of its underlying fee ownership. Instead, the Resolutions will formally declare the identified portions of the City-owned properties for public road, utility, and other municipal purposes.
Recommendation No. 5 will allow the City Council to approve the dedications while the related right- of-way improvements are under construction or preparing to begin construction. The dedication resolutions will be withheld from recordation until the applicable improvements have been completed and accepted by the City. Upon written confirmation from the Public Works Director or designee, the resolutions may be recorded, formally establishing the improved areas as public right-of-way without requiring the dedication actions to return to the City Council.
Summary Vacation of the Irrevocable Offer of Dedication The irrevocable offer of dedication addressed by Resolution No. 3 was made on Tract Map No. 19153 for emergency services access, solid-waste and trash-collection access, vehicular access, and pedestrian access. The City did not accept the offer when the tract map was recorded. The offered easement was Proposed Dedication of Certain City-Owned Properties for Public Road, Utility, and Other Municipal Purposes; Summary Vacation of an Irrevocable Offer of Dedication for Public Access shown on Tract Map No. 19153 (ABA2025-00443); and Summary Vacation of Segments of Excess Douglass Road Right-of-Way (ABA2026-00451)

intended to provide public access from Katella Avenue through Parking Deck B to Stanley Cup Way and Douglass Road.
During the subsequent engineering and design process, the configuration of the required public access area was revised. To reflect the final design, a separate easement deed was recorded on June 9, 2026, as City Deed No. 12926, establishing the public access rights required for the Project. Because the separately recorded easement supersedes and replaces the access rights described in the original offer, the offer shown on Tract Map No. 19153 is no longer required. The proposed summary vacation will terminate the City’s interest in the superseded offer and remove it as a potential encumbrance on the affected property.
Based on the recorded replacement easement and City staff review of the final access configuration, it has been determined that the irrevocable offer of dedication has been superseded by relocation, is no longer required for public access purposes, and may be summarily vacated pursuant to the applicable provisions of the California Streets and Highways Code.
Summary Vacation of Excess Street Right-of-Way
The segments of Douglass Road addressed by Resolution No. 4 were previously dedicated as public street right-of-way but were never physically improved or maintained by the City as public streets, and remain outside the roadway limits established by the Douglass Road improvement plans, which are part of the Project. Following completion of the roadway design, the City staff determined that these segments are not needed for the construction, operation, or future use of Douglass Road and constitute excess street right-of-way.
At the City-owned ARTIC property, approximately 433 square feet of existing Douglass Road right-of- way is proposed for summary vacation. The approved improvement plans also require approximately 898 square feet of the ARTIC property to be dedicated as public right-of-way (Resolution No. 1).
Together, these actions will remove right-of-way that falls outside the approved roadway configuration and dedicate the City-owned property needed to align the ultimate right-of-way with the limits of the completed street improvements.
Adjacent to 1715-1725 South Douglass Road, the future site of Parking Deck A, approximately 1,659 square feet of existing right-of-way is proposed for summary vacation. As part of the Douglass Road improvements, the property owner has separately dedicated approximately 911 square feet of additional right-of-way to the City by City Deed No. 12974. The proposed vacation and the previously completed dedication will align the public right-of-way with the roadway limits established by the City-approved improvement plans.
Based on the City-approved Douglass Road improvement plans, City staff has determined that the proposed vacation areas consist of dedicated but unimproved street right-of-way that was never developed or used as public streets. The areas lie outside and exceed the ultimate right-of-way required for the improved roadway and are not required for present or prospective street or highway purposes.
City departments and affected utility providers have also determined that the proposed vacation areas contain no in-place public utility facilities that are in use or would be affected by the vacations and that Proposed Dedication of Certain City-Owned Properties for Public Road, Utility, and Other Municipal Purposes; Summary Vacation of an Irrevocable Offer of Dedication for Public Access shown on Tract Map No. 19153 (ABA2025-00443); and Summary Vacation of Segments of Excess Douglass Road Right-of-Way (ABA2026-00451)

no public utility or access rights must be reserved. Accordingly, the areas constitute excess street right- of-way eligible for summary vacation pursuant to California Streets and Highways Code Section 8334(a).
