That the City Council, by Ordinance, adopt amendments to various sections of Title 18 (Zoning) of the Anaheim Municipal Code (“Code”) and Adjustment No. 17 to the Festival Specific Plan No. 90-1, Adjustment No. 5 to the Mountain Park Specific Plan No. 90-4, Adjustment No. 17 to the Anaheim Canyon Specific Plan No. 2015- 1, Adjustment No. 12 to the Beach Boulevard Specific Plan No. 2017-1 and determine that these amendments are not subject to CEQA pursuant to Section 15061(b)(3) of the State CEQA Guidelines and Section 21080.085 of the California Public Resources Code.

DISCUSSION:

On July 28, 2026, the City Council introduced the subject Ordinance amending various chapters of Title 18 (Zoning) of the Code and related specific plans to implement programs contained in the City's Sixth Cycle Housing Element.

The proposed amendments implement various State laws currently in effect, which addresses co-location of housing on land owned by religious institutions and nonprofit colleges (Senate Bill [SB] 4), replacement housing requirements (SB 330 and State Density Bonus law), housing discrimination (housing and fair housing laws and “Affirmatively Furthering Fair Housing” law), and emergency shelters (Assembly Bills [AB] 139 and 2339). These amendments also implement the Housing Element Policy Program strategies identified for completion during the 2021–2029 planning period, specifically the Housing Production Strategy 1I and 1U, Housing Conservation and Preservation Strategy 2E(i) and 2E (ii), and Affordable Housing Opportunity Strategy 5O.

In summary, the proposed amendments codify the requirements of SB4, SB 330 and the State Density Bonus law, revise residential definitions and update regulations applicable to Community Care Facilities–Unlicensed and Sober Living Homes to ensure consistency with State housing and fair housing laws, including “Affirmatively Furthering Fair Housing” law, and amend emergency shelter regulations to reflect changes enacted by AB 139 and AB 2339. The amendments also include corresponding revisions to the Festival Specific Plan No. 90-1, Mountain Park Specific Plan No. 90-4, Anaheim Canyon Specific Plan No. 2015-1, and Beach Boulevard Specific Plan No. 2017-1.

A summary of the proposed amendments and the July 28, 2026 City Council staff report are provided as Attachments 2 and 3, respectively. If adopted, the Ordinance will become effective 30 days following adoption.

Environmental Impact Analysis: The City Council previously determined that the proposed amendments are not subject to the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of the State CEQA Guidelines and Section 21080.085 of the California Public Resources Code. The amendments implement programs contained in Anaheim's Sixth Cycle Housing Element, clarify existing development regulations, and align the Anaheim Municipal Code with State housing law. They do not authorize new development or change land use designations beyond those already permitted under existing regulations. As such, the proposed amendments are not subject to CEQA.

IMPACT ON BUDGET:

The costs to process and implement these amendments are included in the Planning and Building Department’s FY 2026/27 General Fund budget.

Respectfully submitted,
Heather Allen
Planning and Building Director
