ATTACHMENT (Y/N): YES ITEM # 08
GOVERNMENT CODE § 84308 APPLIES: NO
RECOMMENDATION:
That the City Council, by Motion, award the contract to the lowest responsible bidder, Boudreau Pipeline Corporation, Corona, CA, Contractor’s License No. 791842, Classification A, C10, C34, and C36, in the amount of $20,088,888, for the Resort Area Sanitary Sewer and Roadway Widening Improvements Project (Project); authorize and direct the Director of Public Works, on behalf of the City, to execute the Contract and any other related documents, and to take such actions as are necessary to implement and administer the Contract; authorize and direct the Finance Director to execute the Escrow Agreement pertaining to contract retentions; and determine the Project is consistent with the previously-certified Final Subsequent Environmental Impact Report No. 352.
DISCUSSION:
The bids are summarized as follows:
1. Boudreau Pipeline Corporation, Corona, CA .........................................$20,088,888.00
2. Big Ben Engineering, Irvine, CA………………………………………$26,901,632.75
3. Sully Miller Contracting Company, Brea, CA……………..…………..$28,381,206.00 The Department of Public Works implemented a Resort Area sanitary sewer study to address sewer needs in the resort area and facilitate development in the resort area. The sewer study identified the best solution to provide a low-maintenance sewer system improvement with the required capacity for the foreseeable future on Katella Avenue including the existing build-out entitlement from the Katella drainage area, the increased need from development, and the latest General Plan Update.
The recommended sewer study improvement consists of constructing a new 21-inch vitrified clay pipe (VCP) sewer line along the south side of Katella Avenue between Disneyland Drive and Harbor Boulevard. In addition, the existing 21-inch and 24-inch sewer lines will be replaced with a new 30-inch VCP sewer line along the north side of Katella Avenue between Walnut Street and Harbor Boulevard. The Project also includes a roadway widening improvement with a new fourth westbound travel lane on the northern side of Katella Avenue from 800 feet west of Harbor Boulevard to Disneyland Drive to mitigate future traffic impacts. Lastly, the Project includes curb-to-curb street Award of Contract to Boudreau Pipeline Corporation for The Resort Area Sanitary Sewer and Roadway Widening Improvements Project August 11, 2026
rehabilitation improvements of the asphalt pavement. The Project does not have any right-of-way impacts to the adjacent properties.
Staff provided extensive community outreach with fliers, door-to-door inquiries, presentations and briefings at the Anaheim Resort Maintenance District meetings to ensure the work minimizes impacts to the community.
In order to ensure success and accelerate the construction timeline, the City has provided an incentive clause (up to $100,000) and disincentive clause of $20,000 per day of liquidated damages to complete the highly trafficked areas of Katella Avenue between West Street to Hotel Way prior to the major convention, National Association of Music Merchants (NAMM), in January 2027 further minimizing impacts to guests, residents, and the resort business community.
The bid price reflects the current bidding environment, appears to be reasonable, and is within the available funding. Liquidated damages for this Project shall be $10,000 per day. Construction is scheduled to begin in the 3rd quarter of 2026 and should be completed in the 1st quarter of 2028.
This Project supports Anaheim’s Strategic Plan Goal C – Invest in Infrastructure and Amenities, specifically Strategy No. 4 – “Improve, enhance, beautify, and maintain major street corridors”, Strategy No. 13 – “Address deferred and ongoing maintenance needs” and Anaheim’s Strategic Plan Goal F – Promote Economic Development and Tourism specifically Strategy No. 1 – “Explore opportunities to maximize the benefits of the 2026 World Cup and the 2028 Olympics.” ENVIRONMENTAL DETERMINATION:
Final Subsequent Environmental Impact Report No. 352 (FSEIR 352) was certified and adopted by City Council on April 17, 2024 via Resolution No. 2024-029, pursuant to the California Environmental Quality Act (CEQA). The sewer improvements and street widening on Katella Avenue are within the scope of the project analyzed in FSEIR 352. No new significant environmental effects or a substantial increase in the severity of previously identified significant effects would result from the Project beyond those analyzed and mitigated in FSEIR 352. Therefore, no further environmental review is required pursuant to CEQA Guidelines Section 15162. Staff will file a Notice of Determination (NOD) upon approval by City Council.
COMMUNITY WORKFORCE AGREEMENT (CWA):
