CITY COUNCIL AGENDA REPORT
City of Anaheim
PLANNING AND BUILDING DEPARTMENT
DATE: AUGUST 25, 2026
FROM: PLANNING AND BUILDING DEPARTMENT
SUBJECT: NUISANCE PROPERTY ORDINANCE DISCUSSION
ATTACHMENT (Y/N): NO ITEM # 26
GOVERNMENT CODE § 84308 APPLIES: NO
REQUESTED ACTION:
That the City Council, by Motion, discuss and provide direction to proceed with the preparation of a chronic nuisance property ordinance for subsequent review as an amendment to the Anaheim Municipal Code (AMC).
DISCUSSION:
At the July 28, 2026 City Council Meeting, Council Member Balius requested to agendize for discussion a chronic nuisance property ordinance that would authorize administrative penalties for properties that repeatedly generate excessive nuisance activity and disproportionate demands on City public safety resources.
If desired to be considered further by the City Council, staff would return at a later date with a draft ordinance to address repeat nuisance service calls. The general framework of the ordinance would include identifying qualifying nuisance activity which could include specified criminal activity and other conduct requiring repeated public safety intervention; objective thresholds such as repeated qualifying incidents within a defined period wherein the thresholds could vary by land use category; and exclusions for specified emergency responses. Escalating administrative penalties would be authorized along with the ability to pursue all legal and equitable remedies to collect unpaid fines.
The current AMC Chapter 6.44 (Nuisances) does not address the concept of a chronic nuisance disproportionately placing demands on public safety resources. The establishment of regulations specific to repeat nuisance service calls add an additional civil enforcement tool for applicable properties.
IMPACT ON BUDGET:
The costs to process and implement these amendments are included in the Planning and Building Department’s FY 2026/27 General Fund budget.
