RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING THE WORKFORCE INNOVATION AND
OPPORTUNITY ACT ON-THE-JOB TRAINING CONTRACT AND
TRAINING PLAN TEMPLATE BETWEEN THE CITY OF ANAHEIM
AND PARTICIPATING EMPLOYERS AND AUTHORIZING THE
WORKFORCE DEVELOPMENT MANAGER TO EXECUTE SUCH
AGREEMENTS ON BEHALF OF THE CITY
WHEREAS, the Workforce Innovation and Opportunity Act (“WIOA”) was signed into law on July 22, 2014 and is designed to help job seekers access employment, education, training, and support services to succeed in the labor market and to match employers with the skilled workers they need to compete in the global economy; and
WHEREAS, WIOA supersedes the Workforce Investment Act of 1998 (“WIA”), under which the City of Anaheim (“City”) was designated by the Governor of the State of California as a Local Workforce Investment Area and had entered into subgrant agreements over several WIA program years with the State of California (“State”) to operate a program under WIA with funds made available by the United States Government to the State, which, in turn, were made available to the City under the subgrant agreements; and
WHEREAS, the City has been designated by the Governor of the State of California as a Local Workforce Development Area under WIOA; and
WHEREAS, utilizing work-based learning strategies available through the American Job Center (“AJC”) network is crucial for assisting adults, dislocated workers, and trade-affected individuals in securing employment; and
WHEREAS, On-The-Job Training (“OJT”) models have proven effective when they involve an ongoing partnership between the business and the workforce system; and WHEREAS, the AJC’s provide individualized career services, identifying appropriate matches between the business and the job seeker and making available any needed supportive services to ensure the OJT participant can successfully engage; and
WHEREAS, OJT provides excellent benefits for individuals to build or update their skills and/or establish themselves in emerging, high-demand fields, while it also incentivizes businesses to hire individuals and invest in their skill development; and
WHEREAS, the United States Department of Labor, Employment and Training Administration, created an On-The-Job Training Toolkit manual, which includes a template OJT Contract and Training Plan (“OJT Contract Template”) that includes all minimum requirements and applicable provisions required by federal statutes and executive orders listed in 2 C.F.R. part 200, Appendix II; and WHEREAS, the City Council desires to authorize use of the OJT Contract Template in the form presented to the City Council as the basis for agreements that will operate to allocate WIOA funds from the City to employers participating in the OJT program in accordance with the terms and provisions of the proposed agreements (“OJT Contracts”); and
2 WHEREAS, the City Council hereby finds and determines that approval of the proposed Agreement is exempt from the provisions of the California Environmental Quality Act and implementing regulations (“CEQA”) pursuant to CEQA Guidelines Sections 15060(c)(3), 15061(b)(3), and 15378(b)(4).
Specifically, the proposed Agreement constitutes a funding mechanism or fiscal activity which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment and does not, therefore, constitute a “project” pursuant to CEQA; and WHEREAS, the City Council has duly considered all of the terms and conditions of the proposed Agreement and any testimony received at the meeting at which this matter was considered, and believes that the activities described therein are in the best interests of the City and the health, safety, morals and welfare of its residents, and in accord with the public purposes and provisions of applicable State and local law requirements.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ANAHEIM AS FOLLOWS:
