SUBJECT
Consider approving a resolution for Maverik, Inc. Liquor License [RECOMMENDATION
The City Manager recommends that the City Council:
Consider adopting a resolution finding the issuance of a Liquor License to the Maverik Stores, Inc in Anderson located at 2590 North Street, to be a public convenience and necessity per Health and Safety Code 23958.4(b)(2) and authorizing the City Manager to issue a letter to ABC stating the Council findings and
FISCAL IMPACT
None.
DISCUSSION and BACKGROUND
"Public convenience or necessity" is a tool for local governments that directly ties them into the state liquor licensing process. Current state law limits the issuance of new licenses in geographical regions defined as high crime areas or in areas of "undue concentration" of retail alcohol outlets (Anderson situation). However, the law also states these restrictions can be avoided in specified circumstances when the state ABC or the local jurisdiction makes a determination that the applicant license proves that the proposed outlet would ITEM 8.3a PAGE 1 2/1/2022
serve "public convenience or necessity" (PC or N). In other words, "public convenience and necessity" is demonstrated when the liquor license applicant proves that the business operation will provide some kind of benefit to the surrounding community. Thus, in addition to making local zoning decisions about alcohol outlet locations and operations, localities now have formal say into the state liquor license process when they actively utilize their authority to make PC or N determination.
Maverik Stores, Inc, Inc. is in the process of locating a store in Anderson at 2590 North Street. As a Maverik Stores, Inc, part of their business includes the sale of alcohol. The State of California has placed a moratorium on the issuance of liquor licenses in each county or city based on their census tract in an attempt to discourage large numbers of alcohol sales in disadvantaged and poorer neighborhoods. The moratorium allows for one license for every 2500 people. With an approximate population of 11,000 people, under the moratorium, the entire city would only be able to have four licenses within their boundaries. However, if the City Council finds that the requested license is of Public Convenience or Necessity, the licensing agency may make an exception to the moratorium and allow additional businesses to be licensed. There is a need for the residents of the City of Anderson to have access to the services a Maverik Stores, Inc store can provide for a community in the form of discounted groceries, supplies, and liquor.
Staff is recommending the Council consider the application for a liquor license, adopt a resolution finding that public convenience or necessity would be served by the issuance of a liquor license to Maverik Stores, Inc, Inc., and authorize the City Manager to issue a letter to ABC the findings of the Council and requesting the license be issued due to public convenience or necessity.

PROJECT DESCRIPTION
APPLICANT: MAVERIK STORES, INC.
LOCATION: 2590 NORTH ST.
ANDERSON, CA 96007
REQUEST: PUBLIC CONVENIENCE OR NECESSITY DETERMINATION TO ALLOW THE
SALE OF BEER & WINE FOR OFF-SITE CONSUMPTION IN CONJUNCTION WITH A NEW MAVERIK TRAVEL CENTER.
The applicant Maverik Stores, Inc. is requesting a Determination of Public Convenience or Necessity in conjunction with the sale of beer & wine for off-site consumption at their new travel center to be located at 2590 North St., Anderson, CA 96007, adjacent to Interstate 5. The applicant will be applying to the Dept. of ABC for a Type #20 License to allow the beer & wine sales. The property is located within Census Tract #121.01. Based on population, the Dept. of ABC has allocated four off-sale licenses to this census tract. There are currently five licenses issued here, therefore the subject Determination of Public Convenience or Necessity has been submitted.
The new Maverik travel center will be located on a property that consists of two generally flat parcels totaling approximately 87,120 sf (2 acres). The property has frontage to the east along North St. near the intersection with McMurray Dr., vehicle ingress and egress will occur from North St. The property is also bordered to the west by Interstate 5. The new operation will include vehicle fueling stations and a 5,637 sf retail market. The property offers 47 on-site parking spaces. Maverik stores operate 24 hours a day, which includes both the fueling services and retail store. Beer & wine sales would be restricted per California state law to 6am to 2am daily.
The store will offer an extensive menu of freshly prepared food items. They are known for their premium BonFire ™ food — made fresh in every Maverik, every day — and awesome values on fuel, drinks and snacks. Maverik sells exclusive products such as fresh-made, gourmet burritos, sandwiches, pizzas, toasted-subs, cookies, and coffee blends from around the world. This is in addition to a large selection of pre-prepared food items, packaged snacks, cold beverages, a small selection of sundries, auto parts useful to travelers, souvenirs, etc. Included in the items for sale will be beer & wine for off-site consumption, which is a standard at all Maverik's locations. Based on the business plan at other Maverik locations, the beer & wine sales are not expected to be a large part of this location's gross receipts. It is simply meant as an additional amenity for those patrons already visiting the store and not intended to be a draw in itself. Of the store's total size of 5,637 sf, the area dedicated to beer & wine display is estimated to be less than 10%. Proposed hours of beer & wine sales will be 6am to 2am daily. This new Maverik location will bring approximately 25 new jobs to the area. 1 The Maverik Store family has been around for over 90 years, and started when a young man from Wyoming decided to open a business in his hometown. In 1928, 20-year-old Reuel Call opened a two-pump gas station in Afton, Wyoming with money he earned from renting roller skates. The business soon grew, and he started providing fuel to surrounding towns and ranches. Maverik now operates more than 350 locations across 11 western states, making it the largest independent fuel marketer in the Intermountain West. This new location in Anderson will be one of Maverik's first operations in California, with plans for 10 additional locations. Maverik employs more than 4,500 people throughout the company. Their employees appreciate the long list of benefits available, including health insurance, 401ks, scholarships and advancement opportunities within the company.
Maverik understands the importance of maintaining the appearance of a facility both for expanding the customer base and preventing criminal activity. Each Maverik location has a property maintenance program to ensure the entire facility is clean and safe. All locations include adequate interior and exterior lighting to help maintain that safe environment and facilitate employee supervision of the facility. While the sale of beer & wine is not the primary focus of the business, Maverik recognizes the seriousness of loitering, delinquency, crime and underage drinking, and is committed to taking all possible steps to address any concerns law enforcement may have about the site.
Maverik stores have an excellent record of compliance regarding the sale of beer & wine, which is accomplished with a high degree of responsibility and conscientiousness. They use a variety of security strategies to ensure the safety of their employees, customers and security of the merchandise.
Maverik uses comprehensive, state-approved computer based alcohol training for all new Adventure Guides (i.e. store clerks). Maverik's program is based on TAM® (Techniques of Alcohol Management) created by NACS. The course has a pretest, 8 courses and a final exam. Each clerk is required to complete and pass this training prior to running a register The course trains and tests on state law requirements, penalties, proper selling techniques, acceptable forms of ID, and detecting a problem with any of the above. Some of the key points include:
• The store could lose its license with a violation of Dept of ABC rules • The employee could be charged with a crime for making a problematic sale • The employee could be subject to a fine or community service for making a problematic sale • Beware of attempted purchases by underage patrons
• Do not "guess" a patron's age, request an ID.
• Review each ID carefully, be aware of false ID's
• No sales to intoxicated persons
This new business will contribute to the economic vitality of the area through sales tax revenue and by providing approximately 25 new jobs. The selling of beer and wine will account for only a small portion of the store floor area and overall sales, but will provide a convenience by offering a more complete selection of products. By providing patrons with a more complete choice of products in a safe and well regulated environment, the public convenience of the area will be served. Otherwise a patron may be obliged to travel to a range of retail outlets in order to complete their shopping needs. The location will also provide a safe and secure environment where visitors may purchase beer and wine without having to go to a liquor store or big box retailer. Thus, the public health, safety, and welfare will be advanced, and the addition of beer and wine sales will not change this.
The Applicant is an established, reputable operator that is limiting alcohol sales to beer and wine, and further limiting alcohol sales to less than 10% of its floor area. The proposed off-sales of beer and wine are sold as incidental products to the goods and services typically sold at a convenience store. The applicant's decision to offer beer and wine is in response to consumer demand. Maverik's patrons appreciate a convenient one-stop shopping experience where they can purchase a few items quickly, instead of visiting a big box store with congested parking, long lines, etc. The limited selection of beer and wine would provide a convenience to existing customers and would be a good destination for people who may not feel comfortable visiting a traditional liquor store. The Applicant provides a safe and clean environment for their patrons, and has an excellent record with each state's Department of Alcoholic Beverage Control. Maverik is looking forward to becoming a responsible member of the Anderson community and would appreciate your support of the subject request for a Letter of Public Convenience or Necessity.

Provide direction on the attendance of ICSC events
FISCAL IMPACT
The fiscal impact is the cost of registration, lodging and travel.
DISCUSSION and BACKGROUND
On January 4, 2022, staff discussed attending the International Council of Shopping Centers now called Innovating Commerce Serving Communities, RECON May 22-24, 2022, with the Council. Upon trying to register for the event the COVID rules appear to create restrictive requirements. Due to the spread of COVID on a large a scale, event organizers are implementing various levels of safety precautions. RECON in Las Vegas is requiring 100% accination with no exceptions. This will likely limit participation. A smaller Californ vent is scheduled for March gth and 9th in Monterev. This is a much smaller event and on.
ITEM 8.3b PAGE 1 2/1/2022
focuses on California. The COVID restrictions for this event will require vaccination or a negative test, which will allow more participants to attend.
For years economic development has been a City Council priority. One of the tools that we have used is to attend the RECON convention and market the City of Anderson to prospective retailers. It also allows us to educate ourselves on market trends and lirection, so we can make good decisions related to development in our City. It has been a couple of years since we have attended. The ability to attend again in 2022 to continue our understanding of the retail marketplace would be highly beneficial. Attendance in the past has been the City Manager, or the City Manager and two City Council members.

There is minimal impact to the general fund in applying for the Grant. The grant request is for $1,699,980. If the City is successful in obtaining this grant there is an expected match from the City of $100,000.
IDISCUSSION and BACKGROUND
In 2018 California voters approved Proposition 68 which authorized $4 billion in general obligation bonds for state and local parks, environmental protection and restoration projects, water infrastructure projects, and flood protection projects. An element of this ITEM 8.6 PAGE 1 2/1/2022
funding is the Rural Recreation and Tourism Program allocating $23,125,000 to Counties, Cities, and Eligible Districts in California.
Staff, with help from a consultant, is recommending a new Bike Park in Anderson River Park as a competitive project to use in an application for these funds.
Through conversations with many local stakeholders, staff has pinpointed biking opportunities as a key area for improvement in our city. A new Bike Park would bring yet another great recreational activity to Anderson River Park that can be enjoyed by many ages and skill levels alike.
As noted above, the requirement of the application is for Council to adopt a resolution to apply for this grant.

DISCUSSION and BACKGROUND
In 2015 the California Legislature approved Senate Bill 555 and Sections 10608.34 of the California Water Code. This bill would require each urban retail water supplier, on or before October 1, 2017, and on or before October 1 of each year thereafter, to submit a completed and validated water loss audit report for the previous calendar year or previous fiscal year as prescribed by rules adopted by the Department of Water Resources on or before January 1, 2017, and updated as provided. The bill would require the California Department of Water Resources (DWR) to post all validated water loss audit reports on its Internet Web site in a manner that allows for comparisons across water suppliers and to make these reports available for public viewing.
The City's last Validated Water Loss Audit was submitted in 2016, and the 2020 Validated Water Loss Audit was due October 1, 2021. According to the September 8, 2021, letter to the City from the Department of Water Resources (DWR), non-compliant water agencies are reported to the
