AGENDA ITEM
I March 1, 2022 City Council Meeting
Approved for Submittal By:
To:
Through:
Honorable Mayor and Members of the Anderson City Council Jeff Kiser, City Manager
From: Collin Bogener, City Attorney
Date: March 1, 2022
!SUBJECT
Approve the bid and contract documents for the Abandoned Vehicle Tow Contractor and authorize staff to go out to bid.
I RECOMMENDATION
The City Attorney recommends that the City Council:
1. Receive a Staff Report
2. Consider approval of the bid and contract documents for the Abandoned Vehicle Tow Contractor and authorize staff to go out to bid.
I FISCAL IMPACT
Unknown at this time.
I DISCUSSION and BACKGROUND
Presently, the Anderson Police Department ("APD") utilizes a rotating list of contractors to provide tow services for abandoned vehicles. The rotating list method has not always been successful as some contractors decline the tow due to cost and effort associated with towing vehicles, particularly large trailers and recreational vehicles.
ITEM 8.2 PAGE1 03/01/2022
However, APO believes that entering into a contractual relationship with a single, experienced, respected towing company, would result in more consistent tows due to the contractual nature of the relationship. For that reason, City staff is proposing that the City go out to bid for an abandoned vehicle tow contractor, with the term of the agreement for a period of three (3) years.
In addition to the bid amount, the successful bidder will also need to possess all required equipment, use only properly licensed and experienced employees, and be compliant with all state, federal and local laws.

2021-2022 Mid-Year Budget Update
I RECOMMENDATION
The Assistant City Manager /Finance Director recommends that the City Council:
No action is requested at time as this is informational only.
I FISCAL IMPACT
This report is informational only.
I DISCUSSION and BACKGROUND
We are at the mid-point of the 2020-2021 budget. Staff would like to take this time to review how revenues and expenditures are performing mid-way through the year.
Revenue and expenditure numbers are recorded through January for the general fund because we receive our first installment of property tax in January so this is approximately 58% of the budget year. Generally, when we discuss General Fund Revenues, we discuss the top 3 categories which are Sales Tax, Property Tax, and Transient Occupancy Tax.
These three (3) categories make up about 81 % of our General Fund Revenues. Below, is a table comparing budgeted general fund revenues to actual receipts for the top three (3) ITEM 8.3 PAGE1 3/1/2022
revenues through January 2021. Additionally, we have added information from the mid· way point of January 2021 as a comparison.

At this time revenues are being received as expected. Property tax receipts show a bit higher percentage than expected. This could be that the original budget numbers for property tax are actually low. The City of Anderson has two current subdivisions under construction. It's often challenging to predict property tax revenue, based on the timing of the number of homes completed during a fiscal year, and placed on the tax roll. Staff will continue to monitor this revenue and recommend a budget adjustment after May when the next payment is received from the County. Transient Occupancy Tax (TOT) is looking to return to pre·pandemic receipts.
General Fund Expenditures
Total general fund expenditures for 2021·2022 were originally budgeted at$ 9,150,242 with actual expenditures through January 2022 (again which is 58% of the budget year) coming in at $6,409,771 or approximately 68%.
Expenditures appear to be a bit higher than the expected 58%, however an item worth mentioning is inflation is much higher currently than when this budget was created. Supply chain issues causing increased prices for goods are contributing to higher expenditure costs. There is however, an inverse effect. The City could see higher revenue in the Sales Tax category due to increased pricing of goods.
Staffing continues to be challenging in several departments of the City i.e., Planning and Building. While several positions are budgeted, the positions remain unfilled. Some of these positions are being covered by consultants at this time. Later in the year, funds in the staffing category may need to be moved to professional services should we continue the need to utilize consultants.
ITEM 8.3 PAGE2 3/1/2022
General Fund Reserve
General Fund reserves as budgeted are projected to increase by $202,413 should revenues and expenditures remain as budgeted. As always. staff continually monitors both revenues and expenditures for needed adjustments.

The Water and Sewer Fund revenues are coming in as projected. Issues in the Water and Sewer Funds are continually provided to the City by way of State mandates such as water conservation measures, drought restrictions. The State of California routinely enacts legislation requiring local governments to implement regulations without necessary funding to finance the regulations. Staff is diligent in balancing the need to maintain the infrastructure while also managing the costs. Wherever possible staff is researching grants that can be used to enhance our financing.
Water fund expenditures are budgeted at $1,631,234.00 and are at 57% or $930,018.00.
Sewer fund expenditures are budgeted at $1,967,687.00 and are at 59% or $1,180,388.78.
No adjustments are recommended at this time.
America Rescue Plan Funds
The American Rescue Plan Act provides funding through the Coronavirus Fiscal Recovery Fund (CFRF) to States, Cities, Counties, Local and Tribal Governments. This funding was put in place to mitigate the effects of the COVID-19 pandemic. The City of Anderson's allocation is $2,542,922. Under the U.S Treasury's final rule governing these funds, Anderson's entire allocation is eligible to be used as general revenue replacement. The funds are distributed in two payments. The first in July of 2021 and the second in July of 2022. The City of Anderson received the first payment of $1,271,461 on July 13, 2021. We expect to receive the second payment in early July 2022.
Because the City's allocation can be used for general revenue replacement, the Council has more discretion in the use of the funds.
Gas Tax Funds and Other funds
State and local gas tax revenues and expenditures are coming in as expected at $ 428,717 or 44% and expenditures are at$ 342,805 or 30%. All other funds of the City are performing as expected at the half-way point in the fiscal year.
ITEM 8.3 PAGE3 3/1/2022
Potential Economic Factors/Trends:
The following economic factors may have a significant effect on the National and Local economies. Staff is actively monitoring these issues for their possible effect on City operations:
StaQing and recruitment
World Wide Economics - Effect from Ukraint:/Russia
Canadian Trucker Convoy/Trucker Convoy in U.S.
Supply Chain issues
Fuels Costs

Discuss possible improvement projects in Anderson River Park
I RECOMMENDATION
The City Manager recommends that the City Council:
1. Receive a Staff Report
2. Provide direction to staff
I FISCAL IMPACT
To be determined
I DISCUSSION and BACKGROUND
We consider Anderson River Park to be one of the City's greatest assets. At over 400 acres the park offers something for everyone and is one of the most popular attractions in the North State.
The park has seen the following improvements, expansion of the amphitheater, new sidewalks, new bathrooms, River Splash, and a pump track. The park has weathered through record floods and snowmageddan but still has lots of opportunities for refurbishment and improvements.
Current projects in the park include the rebuilding of the river trail(currently waiting for OES ITEM 8.4a PAGE1 3/1/2022
and FEMA review and approval), re-roofing the stage at the amphitheater, replacing the play equipment at Kidde Land and we have submitted a grant for a new bike park. For discussion tonight there are lots of items in need of maintenance, replacement and/or improvement. Below I have listed a few ideas in no particular order or priority to begin the discussion. • Additional sidewalk could be placed along the soccer field all the way to the dog park • Resurface the Tennis Courts/Basketball Courts
• Repave the Soccer /River Splash parking lot
• Install Gates at the park entrances
• Replace the playground that was removed when River Splash was built • Construct a small shop with a bathroom for the Parks Maintenance crew • Build the next phase of the amphitheater
• Construct a raft take out

Amend the Classification and Compensation Plan by amending and adding the Job Description for Engineering Technician.
!RECOMMENDATION
The City Manager recommends that the City Council:
Adopt a Resolution amending the Classification and Compensation Plan by amending and adding a job description for Engineering Technician.
I FISCAL IMPACT
This position is currently budgeted in the fiscal year 2021-2022 adopted budget.
I DISCUSSION and BACKGROUND
After reviewing the existing Classification and Compensation Plan, the City Manager recognizes the need for an additional position so that we may maintain quality and effective service levels.
While we are not at a level to justify another full-time management employee for the Engineering department, development has increased to the point we need to consider hiring someone to assist the Public Works Director with the increased workload.
ITEM 8.4b PAGE1 3/1/2022
The City Manager is recommending updating the job description/ duties to includ assisting with issuing of permits; construction inspection of public works projects; maintaining data on water production, consumption, and testing; and other related duties as assigned. A copy of the proposed Job Description for Engineering Technician is attached for review.
This is a rank-and-file position, a copy of this Staff Report and the proposed changes have been provided to the Teamster Local 137.
