Resolutions directing the filing of the Annual Reports for Assessment District No. 1993-2, Landscape and Lighting District No. 2006-1, South Ridge Terrace - Unit 1 Landscaping Maintenance District, and Sanitary Sewer Maintenance District 1-09, Silvergate Subdivision for the 2022/2023 fiscal year.

I RECOMMENDATION
The Assistant City Manager recommends that the City Council:

1. Adopt a resolution directing PACE Engineering, Inc. to file the Annual Report for Assessment District No. 1993-2, with no rate increase or change in assessment methodology. This assessment district does not allow for rate increases.

2. Adopt a resolution directing David Taussig & Associates, Inc. to file the Annual Report for Landscape and Lighting Assessment District No. 2006-1 for the Vineyards at Anderson, with an authorized cost of living increase.

3. Adopt a resolution directing EFS Engineering, Inc. to file the Annual Report for South Ridge Terrace - Unit 1 Landscaping Maintenance District, with an authorized cost of living increase.

ITEM 6.6 PAGE1 5/3/2022

4. Adopt a resolution directing Pace Engineering, Inc. to file the Annual Report for Sanitary Sewer Maintenance District 01-09, Silvergate Subdivision, with an authorized cost of living increase.

I FISCAL IMPACT
The City of Anderson established District No. 1993-2 to offset the cost of electrical energy for streetlights with the City. The assessment revenues received in the prior fiscal year were $60,726.

Assessment District No. 2006-1 was established to maintain the public landscaping and lighting along the streets fronting the first 115 lots within the initial Vineyards at Anderson development. The assessment revenues received in the prior fiscal year were $21,611.

South Ridge Terrace - Unit 1 Landscaping Maintenance District was established to maintain the landscape planter area along the north side of Yellow Finch in the South Ridge Terrace subdivision. The assessment revenues received in the prior fiscal year were $9,736.

The Sanitary Sewer Maintenance District 1-09, Silvergate Subdivision was established to maintain the sewer lift station that services the lots in this subdivision exclusively. The assessment revenues received in the prior fiscal year were $5,120.

I DISCUSSION and BACKGROUND
In 1993, the City of Anderson formed Assessment District 1993-2 under the California Landscape and Lighting District Act of 1972. Although the title of the enabling legislation includes both landscape and lighting, in the City of Anderson this annual assessment is restricted solely to provide funds for electrical energy costs for street lighting and no assessment is made for landscaping. The Landscaping and Lighting Act of 1972 requires that each year following the formation of the District, the legislative body renew the annual assessment. The assessment is $15 per developed parcel, plus $10 for each additional living unit on that developed parcel.

On June 20, 2006, the City of Anderson formed Assessment District No. 2006-1 under the Landscape and Lighting District Act of 1972. The purpose of this District is to maintain the street lights and landscaping within the right-of-way for a portion of the Vineyards subdivision now known as Skyview. The formation documents for Assessment District No. 2006-1 contains a provision allowing annual indexing tied to the published Consumer Price Index. The Assessment Engineer will complete these calculations.

On July 18, 2006, the City of Anderson adopted a resolution forming the South Ridge Terrace - Unit 1 Landscaping Maintenance District. The purpose of this District is to maintain the landscape planter area along the north side of Yellow Finch in the South Ridge Terrace subdivision. The formation documents for the South Ridge Terrace - Unit 1 Landscape Maintenance District contain a provision for annual indexing tied to the published Consumer Price Index. The Assessment Engineer will complete these calculations.

ITEM 6.6 PAGE2 5/3/2022
On March 17, 2009, the City of Anderson adopted a resolution forming the Sanitary Sewer Maintenance District 1-09, Silvergate Subdivision under the Improvement Act of 1911, to maintain the sewer lift station servicing lots in the Silvergate Subdivision. The formation documents for Assessment District No. 2006~1 contain a provision allowing annual indexing tied to the published Consumer Price Index. The Assessment Engineer will complete these calculations.

The first step for placing the annual assessments is for the City Council to direct the engineers of record, PACE Engineering Inc., David Taussig & Associates, Inc., EFS Engineering Inc., and PACE Engineering Inc., respectively, to prepare the various Engineers' Reports. Once complete, these reports are brought back to the Council for adoption.

The proposed schedule for the four renewals is as follows:

Meeting of May 3, 2022
Meeting of June 7, 2022
Meeting of July 5, 2022

ITEM 7.0 PAGE1 5/3/2022
I DISCUSSION and BACKGROUND
Effective January 1, 2022, Assembly Bill (AB) 481 requires law enforcement agencies to obtain approval of the applicable governing body (Anderson City Council), by adoption of a military equipment use policy prior to taking certain actions relating to the funding, acquisition, or use of military equipment, as defined.

AB 481 requires each law enforcement agency's governing body to adopt a written military use policy by ordinance in addition to other requirements by the bill. The following are required:
o Publish the draft military equipment use policy to the Police Department's website 30 days ahead of a public hearing to approve the policy. o Obtain approval by the applicable governing body (Mayor and City Council), by adoption of a military equipment use policy prior to taking certain actions relating to the funding, acquisition, or use of military equipment, as defined. (See definitions below)
o Publish an annual report by the law enforcement agency to include each type of military equipment approved by the governing body.
o Annual review of the military equipment use ordinance by the governing body, and option to either disapprove a renewal of a type of military equipment or amend the military equipment use policy if it determines that the military equipment does not comply with standards for approval.
o Hold at least one well-publicized and conveniently located community engagement meeting within 30 days of submitting and publicly releasing the annual military equipment report.

AB 481 designates the following categories of items as military equipment:
o Unmanned, remotely piloted, powered aerial or ground vehicles o Mine-resistant ambush-protected vehicles or armored personnel carriers o High mobility multipurpose wheeled vehicles (HMMWV), two-and-one-half-ton trucks, five-ton trucks, or wheeled vehicles that have a breaching or entry apparatus attached
o Tracked armored vehicles that provide ballistic protection to their occupants and utilize a tracked system instead of wheels for forward motion o Command and control vehicles that are either built or modified to facilitate the operational control and direction of public safety units o Weaponized aircraft, vessels, or vehicles of any kind o Battering rams, slugs, and breaching apparatuses that are explosive in nature ITEM 7.0 PAGE2 5/3/2022
o Firearms and ammunition of .50 caliber or greater, excluding standard-issue shotguns and standard-issue shotgun ammunition
o Specialized firearms and ammunition of less than .50 caliber, including firearms and accessories identified as assault weapons in Penal Code§ 30510 and Penal Code §30515, with the exception of standard-issue handguns
o Any firearm or firearm accessory that is designed to launch explosive projectiles o "Flash bang" grenades and explosive breaching tools, "tear gas," and "pepper balls," excluding standard, service-issued handheld pepper spray o Taser Shockwave, microwave weapons, water cannons, and long-range acoustic devices
o Projectile launch platforms and their associated munitions including 40mm projectile launchers, "bean bag," rubber bullet, and specialty impact munition weapons
o Any other equipment as determined by a governing body or a state agency to require additional oversight
As is evident from the list above, the definition of "military equipment" is incredibly broad and encompasses items not traditionally included within that classification.

The Anderson Police Department has met the initial requirements of AB 481. The proposed policy was published on the APD website at least 30 days prior to this meeting. The policy itself meets the requirements of AB 481. as it includes the list of all equipment named under the bill. It is also being introduced by ordinance, meeting that requirement.

The item will be brought back annually for the Council to review the ordinance and ensure compliance with the applicable law. Moreover, APD will prepare an annual report updating any information included in the initial policy and including a summary of how the equipment was used during the preceding year. This annual report will also be published on the APD website and a well, publicized public meeting will be held to discuss the contents of the report.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF REDDING DOES ORDAIN AS FOLLOWS:

Section 1. Determinations and Orders.

1. Anderson Police Department Policy 706 meets the requirements of subdivision ( d) of Government Code section 7070 because substantial evidence in the record establishes that:

If any section, subsection, subdivision, paragraph, sentence, clause or phrase of this Ordinance, or its application to any person or circumstance, is for any reason held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the validity or enforceability of the remaining sections, subsections, subdivisions, paragraphs, sentences, clauses or phrases of this Ordinance, or its application to any person or circumstance. The City Council of the City of Anderson hereby declares that it would have adopted each section, subsection subdivision paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more other sections, subsections subdivisions paragraphs, sentences, clauses or phrases hereof be declared invalid or unenforceable.

!RECOMMENDATION
The Deputy Public Works Director recommends that the City Council:

1. Authorize the purchase of a new ten cubic yard sewer /storm drain flusher vacuum truck in the amount of $543,994.19 from Owen Equipment of Fairfield, California

2. Authorize the City Manager to enter into a five-year, fully amortized, 3.7% leasepurchase financing from Municipal Finance Corporation of Calabasas, California to finance the purchase.

ITEM 8.9 PAGE1 5/03/2022

I FISCAL IMPACT
The City of Anderson has been conditionally awarded a grant for approx. $262,000.00 for the purchase of a new flusher /vacuum truck. The remaining balance will be financed through Municipal Finance Corporation of Calabasas California. The annual debt service payments will be $66,821.22 payable out of the equipment maintenance internal service fund. The lease-purchase agreement calls for payments in arrears making the first annual payment due in the FY 2023-2024.

I DISCUSSION and BACKGROUND
The City's current sewer/storm drain flusher vacuum truck is fourteen years old, in need of significant repairs and is no longer a reliable piece of equipment. The primary functions of the vacuum truck have been sewer main flushing as required by law, storm drain flushing and water line repairs.

After demonstrating and pricing several pieces of equipment from various vendors, public works staff is recommending that the Council authorize the purchase of a ten cubic yard combination sewer and storm drain flushing and vacuum truck from Owen Equipment of Fairfield, California.

The total price of the equipment is $543,994.19.

2022-2023 Budget Workshop - Revenues and Expenditures
I DISCUSSION and BACKGROUND
General Overview
Tonight's workshop will present revenue and expenditure projections for the Council to consider for the 2022-2023 budget year. On June 15, 2022 staff will return with final budget numbers for Council to approve and conduct a public hearing to adopt the budget for 2022- 2023. Attached to this report are detail sheets for revenues and expenditures. The Capital Improvement Planning information will be provided at a subsequent workshop.

General Fund Revenues
The General Fund is the City's largest operating fund. This fund provides funding for public safety and the general functions of the City. The main sources of revenue in the general fund are: Property Tax, Sales Tax, and Transient Occupancy Tax. Other sources of revenue to the fund are building fees, parks and recreations fees, fines and forfeitures, and miscellaneous small grants. In completing this budget estimate staff is watching several areas of possible concern. World wide events that are affecting the supply chain which in turn is affecting W.S.1 5/3/2022
prices of materials and availability of product. In addition, inflation is adding to changes in revenues and expenditures. While revenues are increased, so are the costs of goods. On a more positive note, building in Anderson is robust as well as consistent inquiries and interest in either buiJding or relocating to Anderson. Several projects are in the planning stages, whiJe others are currently under construction which will add to increased revenue.

Total General fund revenues are estimated at $12,592,407. Projected increases in General Fund Revenue categories are due to inflation as well as the City being awarded American Rescue Act Plan funds in the amount of $2,542,922. In comparing projected numbers from 2021-2022 it's noted that the 2021-2022 are likely to be quite under estimated due to inflation. For example, fuel prices are nearly double now than they were a year. As the year comes to a close staff will be requesting of Council amendments to the budget revenues.

Property Taxes
Property values in 2022-2023 are continuing to show increases due to consistent construction in the City. Property Tax projections are estimated to be $2,200,000 for 2022- 2023.

Sales Taxes
Inflation is causing goods to cost more thus increasing the amount of Sales Tax the City wil1 receive. Depending on the future economy this could increase further or sales revenue could decline. Staff is watching closely and will return to CounciJ with adjustments if needed based on national and world events that would affect this revenue. Staff at this time, is projecting Sales Tax of $3,715,000 and $1,800,000 in Transaction and Use Tax (Measure A) for 2022- 2023.

Transient Occupancy Tax
Staff projections for TOT are estimated at $682,500 for the 2022/2023 fiscal year.

Other General Fund Revenues
Other revenues contributing to the general fund are franchise fees, planning fees, parks and recreation user charges, business license tax and others. With continued construction, building inspection fees and building permits will continue to show growth.

On the following page we show charts reflecting all general fund revenues for the past 10 years, as well as Sales Tax and Property Tax.

The City uses several operating funds to account for different operational needs. We have Water and Sewer Funds, Internal Service Funds, Gas Tax Funds, as well as others.

Water and Sewer Funds
Revenues in the Water fund are estimated to be $1,776,277 with expenditures of $1,737,404. This increases the reserves by $38,873. However, should the Governor institute water restrictions we may need to make adjustments.
4 W.S.1 5/3/2022
Revenues in the sewer fund are estimated to be$ 1,909,173. Expenditures are $1,966,976.

As with the water fund, we will monitor expenditures costs to make adjustments if needed.

These projections estimate will be a decrease to the Sewer Fund reserve of $57,803.

Conclusion
The general fund budget is balanced with an increase to the general fund reserves of $268,533 in the 2022-2023 fiscal year. The following chart depicts several years of general fund reserve increases/decreases.
