AGENDA ITEM
July 19, 2022 City Council Meeting
To:
Through:
Honorable Mayor and Members of the Anderson City Council Jeff Kiser, City Manager
From:
Date:
City Attorney. Collin Bogener and Planning Consultant, Lisa Lozier July 19, 2022
!SUBJECT
Amendment of Design Review Ordinance
I RECOMMENDATION
1. Review the staff report and environmental determination.
2. Open the public hearing and consider public testimony.
3. Adopt an Ordinance (First Reading) amending Chapter 17.62 of the Anderson Municipal Code regarding Design Review and set for adoption (Second Reading) on August 16, 2022.
!FISCAL IMPACT
There is no fiscal impact.
I DISCUSSION and BACKGROUND
Design review is the concept of the City imposing some form of aesthetic regulation over projects developed within the City. This type of regulation is permissible so long as it is reasonably related to the public health, safety, and welfare. Generally, cities are provided broad latitude in exercising this control.
ITEM 8.2a PAGE1 7/19/2022
Chapter 17.62 of the Anderson Municipal Code was adopted in 1998 and titled "Uses Requiring Design Review.'' It created a design review committee and named a secretary to that committee. It outlined projects subject to the committee review and included a list of the required submittals by the applicant. Finally, it included brief sections on the scope of design review and administrative review.
The initial reason for amending Chapter 17.62 pertained to the inclusion of findings for the committee to make prior to issuance of a decision. In adding that section, it became clear that the ordinance as a whole needed updating. These updates were made in the enclosed amendment.
There were a few sections of the amendment that created a significant change. First, the makeup of the committee is being changed. Historically, a member of the Planning Commission would sit on the committee, in addition to a public works department representative and a police department representative. However, the amendment now has the Planning Commission appoint a person of their choosing who is not a member of the Commission. This is to prevent overlap in review by that Commission member.
Second, the administrative design review section is completely repealed and replaced. The new section (17.62.050) provides a list of 8 items that can be reviewed at the staff level without the need to go to the design review committee. Previously, the code stated that minor projects could be approved administratively, but there was no guidance in that regard. This amendment seeks to cure that issue.
Third, specific findings are laid out for the committee to consider when making its decision.
Having these findings provides the committee with a map to making its ultimate decision as opposed to the current language, which provides very broad discretion.
Lastly, the section designating the Director of Community and Economic Development as the secretary has been removed.
PUBLIC NOTICE:
A 10-day public hearing notice of the proposed amendment was published in the RecordSearchlight No public comments on the project have been received at the Planning Department at the time of this report.

Section 2.

The City Council of the City of Anderson hereby declares that it would have adopted each section, subsection subdivision paragraph, sentence, clause or phrase hereof, irrespective of the fact that any one or more other sections, subsections subdivisions paragraphs, sentences, clauses or phrases hereof be declared invalid or unenforceable.

ITEM 8.2b PAGE1 7/19/2022
I DISCUSSION and BACKGROUND
PROJECT DESCRIPTION:
An Ordinance is proposed to incorporate development standards for the keeping of hen chickens within the Single-Family Residential (R-1) zone district in the City of Anderson.
The proposed development standards will be incorporated into existing Anderson Municipal Code (AMC) Section 17.02.135 - Animals, Fowl, and Bee keeping. Development standards for consideration include but are not limited to location where chickens may be kept, number of chickens per residential lot, construction standards for chicken enclosures, required setbacks, proper care and prohibitions.
BACKGROUND AND DISCUSSION:
Locally and in the State of California there is a growing interest in keeping chickens in urban areas. Commonly noted reasons for keeping chickens are for hobby, companionship, traditional lifestyle, food production and insect control. Backyard chickens also supply manure which is good for composting. Typical concerns associated with backyard chickens include noise, odor, and potential health risks.
Historically, the care and placement of animals as addressed in the Zoning Ordinance of the City of Anderson has been delegated to areas on lots, one•half acre and larger permissible for keeping of livestock. Recently the keeping of chickens on smaller lots zoned and developed for single-family residential use has been requested as an allowed use. To incorporate the keeping of chickens as a permitted use in the Single-Family Residential(R1) district, the following standards shall be implemented to regulate keeping of chickens specifically "Hen Chickens" and ensure that the presences of hen chickens in R-1 do not create an undue burden on neighboring residents.
The Planning Commission considered the proposed ordinance on June 27, 2022. By a unanimous 5-0 vote, the Commission recommended the City Council approve Zone Amendment ZA 22-01. To date, no letters of concern have been received by the public.
Section 17.02.135-Animals Fowl and Bee Keeping
Section 17.02.135, as it is currently presented in the AMC, contains four subsections which outline criteria and specific zone districts for the keeping of domestic pets and livestock within the city limits of Anderson (See Attachment C). Subsection A. 1 and 2 detail the keeping of non-domestic animals and fowl in the in the rural estate (RE) or agricultural (AG) zone district unless authorized by a use permit. The proposed ordinance for keeping of Chickens would be included as an additional subsection (17.02.135(A)(3) which would allow for and include specific criteria for the keeping of chickens in the single-family residential district of Anderson (See Attachment B, Ordinance).
Standards specifically addressed in the ordinance include:
ITEM 8.2b PAGE2 7/19/2022
• The number of chickens allowed per R-1 residential lot will be determined by the size of the lot or maximum number. For residential lots less than 8,000 square feet chickens will be allowed at one chicken for each 800 square feet of lot area. For lots larger than 8,000 square feet, a maximum of 10 chicken would be permitted.
Approval of a use permit would be required to increase the number of chickens on anylot.
• Construction Standards for Chicken Enclosures include size restrictions, and materials and when permits will be required.
• Setbacks from front property line, residential structures, and sensitive use such as schools.
• Proper care and prohibitions are included for the wellbeing of the chickens and requirements for sanitary conditions.
PUBLIC NOTICE:
A 10-day public hearing notice of Zone Text Amendment ZA22-01 was published in the Record-Searchlight.
ENVIRONMENTAL DETERMINATION:
The City of Anderson finds that this Ordinance is exempt from the requirements of the California Environmental Quality Act ("CEQA"), and, pursuant to CEQA Guidelines, common sense exemption, 15061(b)(3) with the incorporation of the proposed development standards, there is no possibility the activity in question may have a significant effect on the environment, the adoption of this ordinance is therefore not subject to the provisions requiring environmental review.

Anderson River Park Bandstand and Playground MDG Contract
I RECOMMENDATION
The City Manager recommends that the City Council:
Authorize the City Manager to execute the contract with Melton Design Group to design the Anderson River Park Playground and the Anderson River Park Amphitheater Bandstand Renovation.
I FISCAL IMPACT
Funding for the Amphitheater renovation project is being funded partially with funds from Prop 68, Per Capita Grant in the amount of $177,952. American Rescue Act Funds will provide additional funding for the Amphitheater and for the Anderson River Park Playground.
I DISCUSSION and BACKGROUND
The Amphitheater is home to the City's wildly popular Mosquito Serenade Concert Series.
Just this year the City is celebrating 40 years of concerts in the park! However, it has been several years since the Amphitheater and stage has been renovated. The structure is now in need of renovation to extend the life of the Amphitheater to continue offering concerts, weddings and other events.
ITEM 8.3b PAGE1 7/19/2022
With the construction of River Splash, old playground equipment needed to be removed.
Now that River Splash is open for all to enjoy, it's time to replace playground equipment in the park. This is a project that Council agreed would be an excellent use of American Rescue Act Funds.
Staff is recommending entering into a contract with Melton Design Group to design the above projects. The estimated costs for both of these contracts are $152,680.
Completion of these projects will continue the City's effort to maintain the "Best Park in the Region!

During your first 30 days operating as a fleet manager partner, we want you to be set up for success. Bird provides a risk free, 30-day ramp up period to ensure this partnership is a strong mutual fit for the long-term. You will be partnering with an Engagement Manager from the Bird regional team, and they will be your main contact to ensure a smooth launch of your fleet manager operation. Even beyond the first 30 days, you will be looped in on market compliance and regulations, have access to formalized repair training for the Bird vehicles (prior mechanical experience is highly recommended), and hundreds of Help Center articles to address all of your concerns and needs as you get started.
You and the Bird team will work closely together to drive forward the mission of cleaner and more accessible cities.

Vehicles are picked up regularly to ensure they are charged and assessed for any repairs. Once vehicles are determined to be in proper condition, they are placed back on the street and ready to be ridden.
It is important that the vehicles are placed in optimal locations to receive rides. The app will flag vehicles that should be moved in an effort to increase your earning potential.
You may come across vehicle damages that will require repair before being ridden again. There is repair documentation available that will assist you in facilitating any repair and a Shopify store with all the spare parts you may need to purchase.
You may choose to hire subcontractors or employees to help with your operations on a rotating schedule or for peak season holidays.
Fleet managers also hire for overnight shifts to pick up low battery scooters so they do not go missing.
In order to maintain a positive relationship with your community, you may be asked to pick up improperly parked vehicles that may be in violation of city regulations. Your local team will work with you to make sure compliance concerns are resolved in a timely manner.
Keeping in contact with your Engagement Manager and local team gives you the chance to learn from their operational experience.
Testimonials
My partner and I love being fleet managers. We love to see the joy and fun that not only us as managers experience but seeing the public have a lot of fun and entertainment with the scooters. When you can stop your trailer and unload
practically your whole thing in one spot due to people wanting to ride them. It is a fun and rewarding opportunity.
- Robert Lumley (Duluth, MN) [LONGTAIL]
Bird is truly an unique opportunity to interact with the local community in a way I never knew existed to be honest. I was working two jobs that were extremely boring, and not very rewarding. I needed a change. Bird can definitely bring about its own set of challenges, but at the end of the day, there are a lot of rewards beyond just the monetary payout. I strongly believe in a "work hard, play hard" mentality, and I can say Bird has supported that.
- Kristopher Vaught (KC) [ CORE]
My advice to anyone joining is very simple: you are going to be placed into a program where to be successful takes a whole host of skills and attributes that you probably never really sat down and thought about. Are you actually willing to
understand that the micro mobility game is forever changing, will never be static, and will require you to adapt on the fly, become a jack of trades you never knew existed? If so, hold on, cause it's about to get bumpy, but don't forget to open your eyes for one hell of an adventure!

FAQs
When did the fleet manager partner program launch?
The fleet manager partner program launched early 2020. Bird has been providing partnership opportunities in all size markets to our local operators who are entrepreneurial, enjoy running their business being hands-on, and have a passion bringing micro-mobility into their community.
Where do I sign up?
We are excited you are interested in signing up for the fleet manager program.
Please click here to submit your information for review. If our team feels you are a good fit, we will reach out to you with next steps.
Why is Bird deciding on coming here to my city?
We have done extensive research and analysis that led us to reaching out to your city based on its characteristics and layout. We are excited to partner with the city to bring alternative clean transportation to your town.
How might seasonality affect my business?
If you are in a market that faces challenging/extreme weather (hot or cold), your Bird partner team will help navigate and prepare for those seasonality changes as they come. Birds are stored and off the road when it is required by the city, or when the weather warrants them to be removed. With this in mind, our fleet managers in affected markets maximize revenue during peak seasons to counteract this.
How much mechanical experience do I need?
Although we provide the content to teach you how to repair the vehicles, it is highly recommended that you come in with previous mechanical experience.
Keeping the vehicles well-maintained and on the street are key to your success.
What are examples of common repairs?
Common repairs include brake lever replacements, kickstand replacements, front fork replacements, bell and button replacements, and QR code replacements.
Can I hire employees & set up a team?
Yes, this is your business! You can set up your team and add employees to your payroll as you see fit. The official contract will be listed under your LLC, and access for your employees will be added accordingly (speak to your Bird partner team).
How much storage do I ideally need for storage/charging/repair space? We recommend having no less than 500 square feet of space to store Bird scooters. This can be a residential or commercial space as long as it is enclosed and has ample electricity.
